Sixty-Second Sitting of the Legislative Committee

At the sitting held on 6 October, the Legislative Committee considered in principle the bills and decision proposals included in the agenda of the First Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2009, convened for 6 October, viz.



At the sitting held on 6 October, the Legislative Committee considered in principle the bills and decision proposals included in the agenda of the First Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2009, convened for 6 October, viz. document proposals from the field of defense and security: Proposal of the Decision on the Adoption of the Strategy of National Security of the Republic of Serbia, Proposal of the Decision on the Adoption of the Defense Strategy of the Republic of Serbia, Bill amending and modifying the Defense Law, Bill amending and modifying the Law on the Serbian Military, Bill on Military, Labour and Material Duty, Bill on Civil Service, Bill on the Participation of the Serbian Army and other defense forces in multinational operations outside the borders of the Republic of Serbia and Bill on the Military Security Agency and the Military Intelligence Agency.

The Committee also discussed the Bill on Medals of the Republic of Serbia and the Bill on the Diaspora and Serbs in the Region, in principle.

The Legislative Committee unanimously adopted the opinion that all the proposed documents adhere to the constitutional and legal system of the Republic of Serbia.

The Committee members went on to consider the nine initiatives for the initiation of proceedings for the estimation of constitutionality of provisions of various laws that the Constitutional Court had forwarded to the National Assembly for opinion, viz. provisions of article 9, paragraphs 5 and 6 of the Law on Banks, provisions of articles 1 and 2 and articles 6 through 10 of the Law on Recording and Reporting of Confiscated Property, then the estimation of constitutionality and adherence to the European Charter of Fundamental Rights and Basic Freedoms of provisions of articles 2 and 3, article 4, paragraph 4 and articles 17 and 25 of the Law on the regulation of public debt of the Federal Republic of Yugoslavia based on contracts and fixed-term foreign currency deposits of its citizens at Dafiment Bank, JSC Belgrade and liquidation of foreign currency assets deposited at Private Commerce Bank Montenegro d.d. Podgorica, estimation of the constitutionality of the Law on loan abeyance and write-off on grounds of mandatory health insurance contributions, provisions of article 36 of the Law on the regulation of public debt of the Federal Republic of Yugoslavia based on foreign currency savings of its citizens, estimation of the constitutionality of article 4, paragraphs 5 and 6 and article 28 of the Republic of Serbia 2009 Budget Law, provisions of article 1, paragraph 1 and articles 7 and 8 of the Law on temporary cut in pay i.e. wages, net fees and other income in public administration and the public sector, provisions of article 17 paragraph 1 and article 63 of the Broadcasting Act and provisions of article 155, paragraph 2, article 163, paragraphs 3 and 4 and article 167 paragraph 1 of the Law on Copyright and Related Rights.

Regarding the submitted initiatives for the estimation of constitutionality of the provisions of the abovementioned laws, the Committee decided to inform the Constitutional Court of its opinion that the disputed provisions of said laws do not contradict the Constitution of the Republic of Serbia.
