Seventy-Eighth Sitting of the Legislative Committee

At the sitting held on 2 March, the Legislative Committee discussed in principle eighth Bills included in the agenda for the First Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2010. In addition to the Customs Bill, the Committee members also discussed the Bills amending and modifying the Corporate Income Tax Law, Personal Income Tax Law, as well as the Bills on Pre-School Upbringing and Education and on Pupil and Student Standard.



At the sitting held on 2 March, the Legislative Committee discussed in principle eighth Bills included in the agenda for the First Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2010.

In addition to the Customs Bill, the Committee members also discussed the Bills amending and modifying the Corporate Income Tax Law, Personal Income Tax Law, as well as the Bills on Pre-School Upbringing and Education and on Pupil and Student Standard. They also considered in principle the Bill on the indebtedness of the Republic of Serbia at Erste GCIB Finance I.B.V. Amsterdam, with Erste Bank a.d. Novi Sad as agent, Marfin Bank a.d. Belgrade and Vojvodjanska Banka a.d. Novi Sad, Bill granting guarantee by the Republic of Serbia in favour of Banca Intesa a.d. Belgrade under the debt of Public Enterprise Srbijagas Novi Sad, Bill on the Confirmation of the Agreement between Serbia and Montenegro and the United States of America on the status of the International School of Belgrade, Bill on Wild Game and Hunting and the Bill on the Confirmation of the International Convention for the Protection New Varieties of Plants.

The Committee deemed that the Bills adhered to the Constitution and legal system of the Republic of Serbia and proposed that the National Assembly adopt the abovementioned Bills.

At the proposal of the Committee Chairman, the Committee unanimously formulated the text of the response i.e. opinion to be forwarded to the Constitutional Court regarding the initiatives i.e. proposals to estimate the constitutionality of the provisions of the eighth laws the Constitutional Court had submitted to the National Assembly, viz. the provisions of article 96 of the Bankruptcy Law, provisions of article 11 paragraph 2 of the Law on Burials and Cemeteries, provisions of article 4 paragraph 2 and articles 8, 9, 11 and 12, article 14 paragraph 3, article 30, article 38 paragraph 1 and article 42 of the Law on Political Parties, provisions of articles 24 and 25 of the Law amending and modifying the Misdemeanors Law, provisions of article 16 paragraph 3 of the Law on Higher Education and provisions of articles 110, 111 and 168 of the Law on the Police.

The Committee submitted an identical response to the Constitutional Court regarding the initiative to initiate proceedings for the estimation of constitutionality and compliance with the confirmed international treaty of the Law on Seizure and Confiscation of the Proceeds from Crime and the provisions of article 24 of the Law on Compulsory Traffic Insurance.

The sitting was chaired by the Committee Chairman, Vlatko Ratkovic, while representatives of the submitter took part in the Committee sitting.
