Ninety-Third Sitting of the Administrative Committee

At the sitting held on 27 June, the Administrative Committee unanimously adopted a Decision to create a Working Group to review the provisions of the Law on the National Assembly and National Assembly Rules of Procedure relating to the MPs’ immunity for the purpose of their amendment. The Working Group is tasked with analysing the provisions of the Law on the National Assembly and National Assembly Rules of Procedure relating to the MPs’ immunity as well as informing the Administrative Committee and National Assembly Speaker on the need to possibly amend the regulations.


Regarding the request made by holders of judiciary functions regarding the implementation of MPs’ immunity, the Committee concluded that, in the case of the request of holders of judiciary functions for the National Assembly’s opinion on the implementation of MPs’ immunity to criminal offenses prosecuted under private action, immunity set out in Article 103 paragraph 2 of the Constitution and Article 38 paragraph 2 of the Law on the National Assembly applies.

At the sitting, the Administrative Committee also formulated the text of the memo regarding the request made by holders of judiciary functions to be allowed to prosecute an MP who waved the immunity. The memo specifies that, it the MP waives immunity he/she may be subject to criminal or other proceedings in which prison sentence may be pronounced, without prior approval of the National Assembly, with the provision that the authority carrying out the proceedings is obligated to inform the National Assembly that the proceedings have been filed.
