Fourth Extraordinary Session of the National Assembly of the Republic of Serbia in 2016

At the request of 200 MPs, the Speaker of the National Assembly of the Republic of Serbia Maja Gojkovic convened the Fourth Extraordinary Session of the National Assembly of the Republic of Serbia in 2016, for Tuesday, 9 February, starting at 10 am.


The request to hold the extraordinary session specified the following agenda, bearing 23 items:

1. Bill amending the Law on Prevention of Discrimination against Persons with Disabilities, submitted by the Government;
2. Bill amending and modifying the Law on Culture, submitted by the Government;
3. Bill amending and modifying the Law on Obligatory Copy of Publications, submitted by the Government;
4. Proposal of the Decision to designate the entire area of the cultural and historical complex of the Military Technical Institute in Kragujevac as immovable cultural property of extraordinary significance, submitted by the Government;
5. Proposal of the Decision to set the protected area borders and protection measures for the cultural and historical area of Sremski Karlovci Urban Core immovable cultural property of extraordinary significance, submitted by the Government;
6. Proposal for an authentic interpretation of the provisions of Article 142 of the Law on Public Information and Media (“RS Official Gazette”, No. 83/14 and 58/15), submitted by the Committee on Constitutional and Legislative Issues of the National Assembly;
7. Bill on remedying the consequences of the seizure of assets of Holocaust victims with no living legal heirs, submitted by the Government;
8. Bill amending and modifying the Law on Misdemeanours, submitted by the Government;
9. Bill amending the Law on Organisation of Courts, submitted by the Government;
10. Bill on the Confirmation of the Cooperation Agreement between the Government of the Republic of Serbia and NATO Support and Procurement Organisation (NSPO) on Logistic Support, submitted by the Government;
11. Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia represented by the Ministry of Defence and the Government of the Republic of the Union of Myanmar represented by the Ministry of Defence, submitted by the Government;
12. Proposal of the Decision on the termination of office of public prosecutors, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government of the National Assembly
13. Proposal of the Decision on the termination of office of public prosecutor at a Special Jurisdiction Public Prosecutor’s Office, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government of the National Assembly;
14. Proposal of the Decision on the termination of office of public prosecutor at the Basic Public Prosecutor’s Office in Zajecar, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government of the National Assembly;
15. Proposal of the Decision on the termination of office of President of the Basic Court in Valjevo, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government of the National Assembly;
16. Proposal of the Decision on the election of High Judicial Council elective members from the ranks of judges, submitted by the High Judicial Council;
17. Proposal of the Decision on the election of State Prosecutorial Council elective members from the ranks of public prosecutors and deputy public prosecutors with permanent tenure of office, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government of the National Assembly;
18. Proposal of the Decision on the election of judges to judicial office for the first time, submitted by the High Judicial Council;
19. Proposal of the Decision on the election of judges to judicial office for the first time, submitted by the High Judicial Council;
20. Proposal of the Decision on the election of judges to judicial office for the first time, submitted by the High Judicial Council;
21. Proposal of the Decision on the election of judges to judicial office for the first time, submitted by the High Judicial Council;
22. Proposal of the Decision on the election of judges to judicial office for the first time, submitted by the High Judicial Council;
23. Proposal of the Decision on the election of judge to judicial office for the first time, submitted by the High Judicial Council.

Before commencing the proceedings, the heads i.e. authorised representatives of the parliamentary groups, MPs Nada Lazic, Haji Milorad Stosic, Riza Halimi, Blagoje Bradic, Balsa Bozovic and Dragan Sormaz, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly accepted the proposal of MP Igor Becic to complete a joint debate in principle and single debate on items 2 through 6 on the agenda and a joint debate in principle and single debate on items 7 through 23 on the agenda the session.

The National Assembly then commenced a joint debate in principle on the Bill amending the Law on Prevention of Discrimination against Persons with Disabilities.

Minister of Labour, Employment, Veteran and Social Affairs Aleksandar Vulin provided the rationale for the Bill on the behalf of the submitter.

The National Assembly completed the joint debate in principle on item 1 on the agenda and commenced the joint debate in principle and single debate on items 2 through 6 on the agenda for the session.

On the behalf of the submitter, the proposed documents were elaborated by Minister of Culture and the Media Ivan Tasovac.

By the end of the day, the National Assembly also completed the joint debate in principle and single debate on items 2 through 6 on the agenda for the session

On the second day of the session, 10 February, the National Assembly completed a joint debate in principle and single debate on items 7 through 23 on the agenda the session.

On the behalf of the submitters, the bills and decision proposals were elaborated by Minister of Justice Nikola Selakovic, elective member of the High Judicial Council from the ranks of judges Miroljub Tomic and elective member of the State Prosecutorial Council Majda Rakic.

On the third day of the session, 11 February, before commencing the proceedings, the heads i.e. authorised representatives of the parliamentary groups, MPs Aleksandar Cotric, Enis Imamovic, Nada Lazic, Dragan Jovanovic, M.Sci Dr.med.dent. Blagoje Bradic, MA Aleksandra Jerkov, Milan Novakovic and Sinisa Maksimovic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly commenced and concluded a debate in detail on the Bill amending the Law on Prevention of Discrimination against Persons with Disabilities.

By the end of the day the National Assembly had also completed a debate in detail on the Bill amending and modifying the Law on Culture and the Bill amending and modifying the Law on Obligatory Copy of Publications.

On the fourth day of the session, 12 February, the National Assembly completed a debate in detail on the Bill on remedying the consequences of the seizure of assets of Holocaust victims with no living legal heirs, Bill amending and modifying the Law on Misdemeanours and the Bill amending the Law on Organisation of Courts.

As the National Assembly had completed the debate, in principle and in detail, on all the items on the agenda, the Chair, National Assembly Speaker Maja Gojkovic set Friday, 12 February, as Voting Day on all the items on the agenda for the Fourth Extraordinary Session of the National Assembly of the Republic of Serbia in 2016, starting at 3.20 pm.

Voting Day

On Voting Day, 12 February, by majority vote, the National Assembly passed the Bill amending the Law on Prevention of Discrimination against Persons with Disabilities, Bill amending and modifying the Law on Culture, Bill amending and modifying the Law on Obligatory Copy of Publications, Proposal of the Decision to designate the entire area of the cultural and historical complex of the Military Technical Institute in Kragujevac as immovable cultural property of extraordinary significance, Proposal of the Decision to set area protection borders and protection measures for the cultural and historical area of Sremski Karlovci Urban Core, immovable cultural property of extraordinary significance, both submitted by the Government, Proposal for an authentic interpretation of the provisions of Article 142 of the Law on Public Information and Media (“RS Official Gazette”, No. 83/14 and 58/15), Bill on remedying the consequences of seizure of assets of Holocaust victims with no living legal heirs, Bill amending and modifying the Law on Misdemeanours, Bill amending the Law on Organisation of Courts, Bill on the Confirmation of the Cooperation Agreement between the Government of the Republic of Serbia and NATO Support and Procurement Organisation (NSPO) on Logistic Support and the Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia represented by the Ministry of Defence and the Government of the Republic of the Union of Myanmar represented by the Ministry of Defence.

The National Assembly also passed the Proposal of the Decision on the termination of office of public prosecutor at a Special Jurisdiction Public Prosecutor’s Office, Proposal of the Decision on the termination of office of public prosecutor at the Basic Public Prosecutor’s Office in Zajecar, Proposal of the Decision on the termination of office of President of the Basic Court in Valjevo, Proposal of the Decision on the election of High Judicial Council elective members from the ranks of judges and the Proposal of the Decision on the election of State Prosecutorial Council elective members from the ranks of public prosecutors and deputy public prosecutors with permanent tenure of office.

On Voting Day, the National Assembly also adopted the Proposal of the Decision on the election of judges to judicial office for the first time for the Loznica Basic Court, Sabac Misdemeanour Court, Zrenjanin Misdemeanour Court, Aleksinac Basic Court, Negotin Basic Court, Pirot Basic Court, Vranje Basic Court, Vranje Misdemeanour Court, Nis Misdemeanour Court, Kraljevo Basic Court, Cacak Basic Court, Priboj Basic Court, Krusevac Basic Court, Prijepolje Basic Court, Kragujevac Misdemeanour Court, Kragujevac Basic Court, Ivanjica Basic Court, Gornji Milanovac Misdemeanour Court and Pozarevac Misdemeanour Court.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the session and decided that none of the provisions of the Rules of Procedure had been violated.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, National Assembly Speaker Maja Gojkovic concluded the Fourth Extraordinary Session of the National Assembly of the Republic of Serbia in 2016.
