10th Sitting of the European Integration Committee

At the sitting held on 14 November 2016, the members of the European Integration Committee deliberated on the Bill amending and modifying the Law on Seizure and Confiscation of Proceeds from Crime, in principle.


The Bill was elaborated by Jovan Cosic, senior advisor at the Ministry of Justice, saying that these were the first amendments to the Law on Seizure and Confiscation of Proceeds from Crime since it was passed in 2013. Cosic said that the amendments can be divided into several segments one of which refers to the range of criminal offenses the Law is implemented on such as homicide, robbery, crime against intellectual property and business crime. Some of the amendments also concern the procedure of permanent and temporary seizure of assets, while the procedure for temporary seizure of assets has been simplified by deleting the objection as a legal tool against the ruling and keeping only the complaint.
Jovan Cosic said that what is important for the Committee, concerning the purview of the authorities implementing the Law, is the obligation stipulated in Chapter 24 that the Financial Investigation Unit establish an Asset Recovery Office which is to handle claims within international legal aid.

As regards harmonisation with EU regulations, he stressed that the Bill amending and modifying the Law on Seizure and Confiscation of Proceeds from Crime complies with all six sources of EU law.

Following a debate the European Integration Committee members adopted the Bill amending and modifying the Law on Seizure and Confiscation of Proceeds from Crime, in principle, by majority vote.

The sitting was chaired by Committee Chairperson Marinika Tepic, and attended by the following Committee members and deputy members: Vesna Markovic, Zarko Micin, Marko Blagojevic, Biljana Pantic Pilja, Zvonimir Djokic, Dragan Sormaz, Branko Ruzic, Petar Jojic, Jovan Jovanovic, Maja Videnovic, Muamer Bacevac, Mladen Grujic and Balint Pasztor.
