Second Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2011

National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic convened the Second Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2011 for Tuesday, 18 October 2011, starting at 11 a.m.


The National Assembly adopted the following agenda:

  1. Proposal of the National Strategy of Protection and Rescue in Emergency Situations;
  2. Bill on Residence and Dwelling of Citizens;
  3. Bill on Administrative Inspection,
  4. Bill on Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxic Weapons and on their Destruction;
  5. Bill on Maritime Transport;
  6. Bill on Obligations and Basis of Property Law Relations in Air Transport;
  7. Bill amending the Law on Maintenance of Residential Buildings;
  8. Bill on Communal Activities;
  9. Bill on Mining and Geological Research;
  10. Bill on the Regulation of Relations between the Republic of Serbia and Debtors – Public Funds Beneficiaries for Obligations undertaken under Foreign Loans;
  11. Bill on the Confirmation of the Framework Loan Agreement for Individual Loans between KfW, Frankfurt am Main and the Republic of Serbia and the National Bank of Serbia as agent;
  12. Bill on Games of Chance;
  13. Bill amending and modifying the Law on Foreign Trade Transactions;
  14. Bill on Public-Private Partnership and Concessions;
  15. Bill amending and modifying the Law on the Protection of Plant Breeders’ Rights;
  16. Bill amending and modifying the Law on High Judicial Council;
  17. Bill amending and modifying the Law on State Prosecutorial Council;
  18. Bill on the Confirmation of the Extradition Treaty between the Republic of Serbia and the Republic of Slovenia;
  19. Bill on the Confirmation of the Agreement between the Republic of Serbia and the Republic of Slovenia on Legal Aid in Civil and Criminal Matters;
  20. Bill on the Confirmation of the Defense Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Croatia;
  21. Bill on the Confirmation of the Defense Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Hungary;
  22. Bill on the Confirmation of the Defense Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Federal Republic of Nigeria;
  23. Proposal of the Decision on termination of office of a Securities Commission Member;
  24. Proposal of the Decision on the election of a member of the Governor’s Council of the National Bank of Serbia;
  25. Proposal of the Decision amending the Decision on the election of committee members of the National Assembly of the Republic of Serbia, submitted by the United Regions of Serbia Parliamentary Group;
  26. Proposal of the Decision on the Confirmation of the Securities Commission 2011 Financial Plan and
  27. Proposal to Grant Consent to the Securities Commission Statute.

The National Assembly accepted the proposal of MP Srdjan Mikovic to complete a joint debate in principle and unified debate on items 1 and 2 on the agenda, joint debate in principle and on items 5 and 6 and a joint debate in principle on items 7, 8 and 9. The National Assembly will complete a joint debate in principle and unified debate on items 10, 11 and 12 on the agenda and joint debate in principle on items 13 and 14, as well as 16 and 17 on the agenda. The National Assembly accepted the proposal to complete a joint unified debate on items 18, 19, 20, 21 and 22; 23, 24 and 25; as well as 26 and 27 on the agenda.

The National Assembly accepted the proposal of National Assembly Deputy Speaker Gordana Comic to debate the Response of the Government of the Republic of Serbia to the Interpellation relating to the legitimacy of the work, dealings and accountability of the Minister of Religion and the Diaspora Srdjan Sreckovic submitted by a group of 56 MPs of the Serbian Radical Party Parliamentary Group at a special sitting.

By the end of the work, the National Assembly had conducted and concluded a joint debate in principle and unified debate on the Proposal of the National Strategy of Protection and Rescue in Emergency Situations and the Bill on Residence and Dwelling of Citizens. The Bills were elaborated by the Minister of Human and Minority Rights, Public Administration and Local Self-Government Milan Markovic.


On the second day of work, 19 October, the National Assembly completed a joint debate in principle on the Bill on Administrative Inspection.


On the third day of work, 20 October, the National Assembly continued the session with a debate in principle on the Bill on Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxic Weapons and on their Destruction.

At the beginning of the proceedings, MPs Nikola Krpic, Cedomir Jovanovic, Milos Aligrudic, Miroslav Markicevic, Jelena Travar-Miljevic, Dragan Todorovic and Nada Kolundzija requested information and explanations in line with article 286 of the Rules of Procedure.

In the morning part of the proceedings the National Assembly completed the debate in principle on the Bill on Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxic Weapons and on their Destruction, elaborated on the behalf of the submitter by Minister of Justice Snezana Malovic.

After recess, the National Assembly completed a joint debate in principle on items 5 and 6 on the agenda i.e. the bills on Maritime Transport and on Obligations and Basis of Property Law Relations in Air Transport. The National Assembly completed a joint debate in principle on items 7, 8 and 9 on the agenda i.e. the Bill amending the Law on Maintenance of Residential Buildings, Bill on Communal Activities and the Bill on Mining and Geological Research.

All the bills were elaborated by Minister of Environment, Mining and Spatial Planning Oliver Dulic.


On the fourth day of work, 25 October, at the beginning of the proceedings, MPs Slobodan Samardzic and Dragan Todorovic requested information and explanations in line with article 286 of the Rules of Procedure.

In the morning part of the proceedings, the National Assembly completed a joint debate in principle and unified debate on items 10, 11 and 12 on the agenda i.e. the Bill on the Regulation of Relations between the Republic of Serbia and Debtors – Public Funds Beneficiaries for Obligations undertaken under Foreign Loans, Bill on the Confirmation of the Framework Loan Agreement for Individual Loans between KfW, Frankfurt am Main and the Republic of Serbia and the National Bank of Serbia as agent and the Bill on Games of Chance. The Bills were elaborated by the Prime Minister of the Republic of Serbia Mirko Cvetkovic.

For the remainder of the day, the National Assembly conducted a joint debate in principle on the Bill amending and modifying the Law on Foreign Trade Transactions and the Bill on Public-Private Partnership and Concessions.

On the fifth day of work, 26 October, the National Assembly completed a joint debate in principle on the Bill amending and modifying the Law on Foreign Trade Transactions and the Bill on Public-Private Partnership and Concessions.

In the continuation, the National Assembly completed a debate in principle on the Bill amending and modifying the Law on the Protection of Plant Breeders’ Rights, elaborated on the behalf of the submitter by Minister of Agriculture, Trade, Forestry and Water Management Dusan Petrovic.

The Chair, National Assembly Deputy Speaker Gordana Comic informed the MPs that part of the session was being viewed from the gallery of the Grand Hall of the National Assembly House by 15 top students from Lapovo, guests from the Lapovo Youth Office visiting the National Assembly, and greeted them on the behalf of the MPs and herself.

In the course of the morning part of the proceedings, the Chair, National Assembly Deputy Speaker Gordana Comic reprimanded MP Radisa Ilic for the first time, and issued a second reprimand to MP Dobrislav Prelic.

After recess, the National Assembly completed a joint debate in principle on the Bill amending and modifying the Law on High Judicial Council and the Bill amending and modifying the Law on State Prosecutorial Council, elaborated on the behalf of the submitter by Minister of Justice Snezana Malovic.

On the sixth day of work, 27 October, the National Assembly conducted a joint debate on the five bills on the confirmation of international agreements and contracts listed as items 18 to 22 on the agenda. The bills were elaborated by Minister of Justice Snezana Malovic.

At the beginning of the proceedings, MPs Riza Halimi, Zoran Nikolic and Boris Aleksic requested information and explanations in line with article 286 of the Rules of Procedure.

In the course of the proceedings, the National Assembly concluded the joint debate on items 18 to 22 on the agenda.

On the seventh day of work, 1 November, the National Assembly conducted a unified debate on the Proposal of the Decision on termination of office of a Securities Commission Member, Proposal of the Decision on the election of a member of the Governor’s Council of the National Bank of Serbia and the Proposal of the Decision amending the Decision on the election of committee members of the National Assembly of the Republic of Serbia.

The National Assembly also conducted a unified debate on the Proposal of the Decision on the Confirmation of the Securities Commission 2011 Financial Plan and the Proposal to Grant Consent to the Securities Commission Statute, submitted by the Securities Commission.

At the beginning of the proceedings, MPs Slobodan Samardzic, Boris Aleksicand Mihajlo Puric requested information and explanations in line with article 286 of the Rules of Procedure.

National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic greeted a group of Roma students, on the behalf of the MPs and herself, who had enrolled in the first year of University in the 2011/2012 academic year. They followed part of the session from the gallery of the National Assembly House Grand Hall.

On the eighth day of work, 2 November, the National Assembly completed a debate in detail on the Bill on Residence and Dwelling of Citizens.

The Chair, National Assembly Deputy Speaker Gordana Comic informed the MPs that part of the session was being viewed from the gallery of the Grand Hall of the National Assembly House by the members of the Students Association of the Kragujevac Faculty of Law visiting the National Assembly, and greeted them on the behalf of the MPs and herself.

In the course of the morning part of the proceedings, the Chair, National Assembly Deputy Speaker Gordana Comic reprimanded MP Nemanja Sarovic.

After recess, the National Assembly completed a debate in detail on the Bill on Administrative Inspection.

On the ninth day of work, 3 November, the National Assembly conducted and concluded a debate in detail on the Bill on Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxic Weapons and on their Destruction.

At the beginning of the proceedings, the heads i.e. authorised representatives of the parliamentary groups Riza Halimi, Prof. Dr Zoran Sami, Dejan Mirovic and Janko Veselinovic requested information and explanations in line with article 286 of the National Assembly Rules of Procedure.

On the tenth day of work, 8 November, the National Assembly conducted and, in the morning part of the proceedings, concluded a debate in detail on the Bill on Maritime Transport and the Bill on Obligations and Basis of Property Law Relations in Air Transport.

At the beginning of the proceedings, MPs Zoran Nikolic, Vjerica Radeta and Gordana Comicrequested information and explanations in line with article 286 of the Rules of Procedure.

National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic greeted the students of the Military Grammar School and Milutin Milankovic European Business School from Belgrade who viewed part of the session from the gallery of the Grand Hall, on the behalf of the MPs and herself.

On the eleventh day of work, 9 November, the National Assembly conducted and concluded a debate in detail on the Bill amending the Law on Maintenance of Residential Buildings, Bill on Communal Activities and the Bill on Mining and Geological Research.

National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic greeted the members of the Pensioners’ Association from Hrtkovci who viewed part of the session from the gallery of the Grand Hall, on the behalf of the MPs and herself.

On the twelfth day of work, 10 November, the National Assembly conducted and concluded a debate in detail on the Bill on the Regulation of Relations between the Republic of Serbia and Debtors – Public Funds Beneficiaries for Obligations undertaken under Foreign Loans and the Bill on Games of Chance.

At the beginning of the proceedings, MPs Zeljko Tomic and Zoran Krasicrequested information and explanations in line with article 286 of the Rules of Procedure.

On the thirteenth day of work, 14 November, the National Assembly conducted and concluded a debate in detail on the Bill amending and modifying the Law on Foreign Trade Transactions, Bill on Public-Private Partnership and Concessions and the Bill amending and modifying the Law on the Protection of Plant Breeders’ Rights.

By the end of the day, the National Assembly had concluded a debate in detail on the Bill amending and modifying the Law on High Judicial Council and the Bill amending and modifying the Law on State Prosecutorial Council.

As the National Assembly had completed the debate on all the items on the agenda, National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic set Thursday, 17 November 2011, as Voting Day on the items on the agenda for the Second Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2011, starting at 10 a.m.

Voting Day

The National Assembly commenced the Voting Day sitting on 17 November. By a majority of votes the National Assembly adopted the Proposal of the National Strategy of Protection and Rescue in Emergency Situations, Bill on Residence and Dwelling of Citizens, Bill on Administrative Inspection, Bill on Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxic Weapons and on their Destruction, Bill on Maritime Transport and the Bill on Obligations and Basis of Property Law Relations in Air Transport.

In the course of the voting, National Assembly Speaker Prof. Dr Slavica Djukic Dejanovic noted a lack of quorum so she scheduled the continuation of the Voting Day on the items on the agenda for the Second Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2011, for Monday, 21 November, at 1 p.m.

In the continuation of the Voting Day, on 22 November, by a majority of votes, the National Assembly adopted the Bill amending the Law on Maintenance of Residential Buildings, Bill on Communal Activities and the Bill on Mining and Geological Research.

 

The National Assembly adopted the Bill on the Regulation of Relations between the Republic of Serbia and Debtors – Public Funds Beneficiaries for Obligations undertaken under Foreign Loans and the Bill on the Confirmation of the Framework Loan Agreement for Individual Loans between KfW, Frankfurt am Main and the Republic of Serbia and the National Bank of Serbia as agent.

 

In addition, the National Assembly adopted the Bill on Games of Chance, Bill amending and modifying the Law on Foreign Trade Transactions, Bill on Public-Private Partnership and Concessions and the Bill amending and modifying the Law on the Protection of Plant Breeders’ Rights.

 

The Bill amending and modifying the Law on High Judicial Council and the Bill amending and modifying the Law on State Prosecutorial Council were also adopted.

 

On Voting Day, the National Assembly adopted the Bill on the Confirmation of the Extradition Treaty between the Republic of Serbia and the Republic of Slovenia, Bill on the Confirmation of the Agreement between the Republic of Serbia and the Republic of Slovenia on Legal Aid in Civil and Criminal Matters, Bill on the Confirmation of the Defense Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Croatia, Bill on the Confirmation of the Defense Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Hungary and the Bill on the Confirmation of the Defense Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Federal Republic of Nigeria.

 

The National Assembly also adopted the Proposal of the Decision on termination of office of a Securities Commission Member, Proposal of the Decision on the election of a member of the Governor’s Council of the National Bank of Serbia, Proposal of the Decision amending the Decision on the election of committee members of the National Assembly of the Republic of Serbia, submitted by the United Regions of Serbia Parliamentary Group, Proposal of the Decision on the Confirmation of the Securities Commission 2011 Financial Plan and the Proposal to Grant Consent to the Securities Commission Statute.

 

The National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the sitting and decided that none of the provisions of the Rules of Procedure had been violated.

 

As the National Assembly had completed the discussion on all the items on the agenda for the sitting and ruled on them, National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic concluded the Second Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2011.
