Ninth Extraordinary Session of the National Assembly in 2012

At the request of 123 MPs, the National Assembly Speaker, MA Nebojsa Stefanovic, convened the Ninth Extraordinary Session of the National Assembly of the Republic of Serbia in 2012, for Tuesday, 18 September 2012, starting at 3 pm.


The request to hold the session specifies the following agenda:

1. Bill amending and modifying the Law on Tax Procedure and Tax Administration, submitted by the Government,
2. Bill amending and modifying the Value Added Tax Law, submitted by the Government,
3. Bill amending and modifying the Personal Income Tax Law, submitted by the Government,
4. Bill amending and modifying the Excise Tax Law, submitted by the Government,
5. Bill amending and modifying the Law on Tobacco, submitted by the Government,
6. Bill amending the Law on Republic Administrative Fees, submitted by the Government,
7. Bill amending and modifying the Law on Fiscal Cash Registers, submitted by the Government,
8. Bill amending and modifying the Law on Local Self-Government Funding, submitted by the Government,
9. Bill amending and modifying the Law on Tourism, submitted by the Government,
10. Bill amending the Law on Privatisation, submitted by the Government,
11. Bill amending the Law on Compulsory Traffic Insurance, submitted by the Government,
12. Bill amending the Law on Ionizing Radiation Protection and Nuclear Safety, submitted by the Government,
13. Bill on the Expiry of the Law on the Environmental Protection Fund, submitted by the Government,
14. Bill amending the Law on Chemicals, submitted by the Government,
15. Bill amending the Law on Waters, submitted by the Government,
16. Bill amending the Law on Forests, submitted by the Government,
17. Bill amending the Law on Livestock Breeding, submitted by the Government,
18. Bill amending the Law on Wine, submitted by the Government,
19. Bill amending and modifying the Veterinary Medicine Law, submitted by the Government,
20. Bill amending and modifying the Law on Court Fees, submitted by the Government,
21. Bill amending the Air Transport Law, submitted by the Government,
22. Bill amending and modifying the Law on Public Roads, submitted by the Government,
23. Bill amending and modifying the Law on Emergency Situations, submitted by the Government,
24. Bill amending and modifying the Law on Energy, submitted by the Government,
25. Bill amending and modifying the Republic of Serbia 2012 Budget Law, with its accompanying proposals of decisions granting consent to the decisions amending and modifying the financial plans for 2012 of:
1) the Republic Pension and Disability Insurance Fund,
2) the Republic Health Insurance Fund, and
3) the National Employment Service, submitted by the Government,
26. Bill amending and modifying the Budget System Law, submitted by the Government,
27. Bill amending the Pension and Disability Insurance Law, submitted by the Government,
28. Bill Establishing Maximum Earnings in the Public Sector, submitted by the Government,
29. Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia and the Government of the People’s Democratic Republic of Algeria, submitted by the Government,
30. Bill on the Confirmation of the Memorandum of Understanding between the Government of the Republic of Serbia and the United Nations on the contribution to the United Nations Stand-By Arrangements System, submitted by the Government,
31. Bill on the Confirmation of the Proposal of Amendments to the International Monetary Fund Statute on the reform of the Executive Board, submitted by the Government,
32. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Moldova on readmission or persons residing illegally and the Protocol on the implementation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Moldova on readmission or persons residing illegally, submitted by the Government,
33. Proposal for the Election of Vice Governor of the National Bank of Serbia, submitted by the Governor of the National Bank of Serbia,
34. Proposal of the Decision on the election of the Council of the State Audit Institution, submitted by the Committee on Finance, State Budget and Control of Public Spending,
35. Proposals of Decisions amending the Decision on the election of members and deputy members of the committees of the National Assembly of the Republic of Serbia, submitted by the Democratic Party – Vojislav Kostunica Parliamentary Group, Social Democratic Party Parliamentary Group, Socialist Party of Serbia Parliamentary Group, United Regions of Serbia Parliamentary Group and New Serbia Parliamentary Group and
36. Proposal of the Decision amending the Decision on the establishment of the composition of the standing delegations of the National Assembly of the Republic of Serbia to international parliamentary institutions, submitted by the United Regions of Serbia Parliamentary Group.

Before moving on to the agenda, based on the Report of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the termination of the terms of office of MPs Prof. Dr Zoran Masic, Bosko Nicic, Prof. Dr Nebojsa Zdravkovic and Milosav Milickovic, before the expiry of the term they were elected for.

The heads i.e. authorised representatives of the parliamentary groups, MPs Petar Petkovic, Miljenko Dereta, Aleksandar Jugovic, Djordje Stojsic, Miletic Mihajlovic, Maja Gojkovic, Ivan Karic and Borko Stefanovic requested information and explanations in line with article 278 of the National Assembly Rules of Procedure.

By a majority of votes, the National Assembly accepted the proposal of MP Zoran Babic to complete a joint debate in principle on items 1 through 24 on the agenda, joint debate in principle and single debate on items 25, 26, 27 and 28 on the agenda, as well as a joint single debate on items 29, 30, 31 and 32 on the agenda and a joint single debate on items 33, 34, 35 and 36 on the agenda for the session.
The National Assembly went on to commence a joint debate in principle on items 1 through 24 on the agenda for the session.
The Bills were elaborated by Minister of Finance and Economy Mladjan Dinkic, representative of the submitter.
For the rest of the day, the National Assembly conducted the joint debate in principle on items 1 through 24 on the agenda for the session.

On the second day of work, 19 September, the National Assembly continued the joint debate in principle on items 1 through 24 on the agenda for the session.

Based on the Decision of the Republic Electoral Commission on the allocation of MPs’ terms of office for the purpose of filling vacant seats at the National Assembly and the Report of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the verification of the terms of office of MPs Nebojsa Beric and Irena Aleksic, elected from the LET’S GET SERBIA MOVING – TOMISLAV NIKOLIC Electoral List, and MP Rajko Stevanovic elected from the UNITED REGIONS OF SERBIA – MLADJAN DINKIC Electoral List. After their terms of office were verified, the newly-elected MPs took the oath of office.

By the end of the day, the National Assembly had concluded the joint debate in principle on items 1 through 24 on the agenda.

On the third day of work, 20 September, the National Assembly conducted and concluded the joint debate in principle and single debate on the Bill amending and modifying the Republic of Serbia 2012 Budget Law, with its accompanying proposals of decisions granting consent to the decisions amending and modifying the financial plans for 2012 of: 1) the Republic Pension and Disability Insurance Fund, 2) the Republic Health Insurance Fund, and 3) the National Employment Service, as well as the Bill amending and modifying the Budget System Law, Bill amending the Pension and Disability Insurance Law and the Bill Establishing Maximum Earnings in the Public Sector.

At the beginning of the proceedings, the heads i.e. authorised representatives of the parliamentary groups, Sasa Dujovic, Judita Popovic, Dusan Milisavljevic, Mirko Cikiriz and Marko Jaksic requested information and explanations in line with article 278 of the National Assembly Rules of Procedure.

Minister of Finance and Economy, Mladjan Dinkic, elaborated the bills as the representative of the submitters.

By the end of the day, the National Assembly had completed the joint single debate on items 29 to 32 on the agenda – the Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia and the Government of the People’s Democratic Republic of Algeria, Bill on the Confirmation of the Memorandum of Understanding between the Government of the Republic of Serbia and the United Nations on the contribution to the United Nations Stand-By Arrangements System, Bill on the Confirmation of the Proposal of Amendments to the International Monetary Fund Statute on the reform of the Executive Board and the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Moldova on readmission or persons residing illegally and the Protocol on the implementation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Moldova on readmission or persons residing illegally.

The bills were explained, on the behalf of the submitters, by Aleksandar Vucic, First Deputy Prime Minister responsible for defence, security and the fight against corruption and crime and Minister of Defence.

On the fourth day of work, 21 September, the National Assembly continued the session with a joint single debate on the Proposal for the Election of Vice Governor of the National Bank of Serbia, Proposal of the Decision on the election of the Council of the State Audit Institution, Proposals of the Decisions amending the Decision on the election of members and deputy members of the committees of the National Assembly of the Republic of Serbia and the Proposal of the Decision amending the Decision on the establishment of the composition of the standing delegations of the National Assembly of the Republic of Serbia to international parliamentary institutions.

The Proposal for the Election of Vice Governor of the National Bank of Serbia was elaborated by the submitter, Jorgovanka Tabakovic, Governor of the National Bank of Serbia.

By the end of the day, the National Assembly had concluded the joint single debate on items 33, 34, 35 and 36 on the agenda.

On the fifth day of work, 22 September, the National Assembly conducted and concluded the debate in detail on the Bills on the agenda for the Ninth Extraordinary Session of the National Assembly in 2012.

As the National Assembly had concluded the debate in principle and in detail on all the items on the agenda for the Ninth Extraordinary Session, the Chair, National Assembly Deputy Speaker Vesna Kovac, set Tuesday, 25 September 2012, as Voting Day on the items on the agenda for the Ninth Extraordinary Session of the National Assembly in 2012, starting at 11 am.

Voting Day

On Voting Day, 25 September 2012, the National Assembly adopted the Bill amending and modifying the Law on Tax Procedure and Tax Administration, Bill amending and modifying the Value Added Tax Law, Bill amending and modifying the Personal Income Tax Law, Bill amending and modifying the Excise Tax Law, Bill amending and modifying the Law on Tobacco, Bill amending the Law on Republic Administrative Fees, Bill amending and modifying the Law on Fiscal Cash Registers and the Bill amending and modifying the Law on Local Self-Government Funding, by a majority of votes.
The National Assembly also adopted the Bill amending and modifying the Law on Tourism, Bill amending the Law on Privatisation, Bill amending the Law on Compulsory Traffic Insurance, Bill amending the Law on Ionizing Radiation Protection and Nuclear Safety, Bill on the Expiry of the Law on the Environmental Protection Fund, Bill amending the Law on Chemicals, Bill amending the Law on Waters, Bill amending the Law on Forests, Bill amending the Law on Livestock Breeding, Bill amending the Law on Wine, Bill amending and modifying the Veterinary Medicine Law, Bill amending and modifying the Law on Court Fees, Bill amending the Air Transport Law, Bill amending and modifying the Law on Public Roads, Bill amending and modifying the Law on Emergency Situations and the Bill amending and modifying the Law on Energy.
By 135 MPs' votes, the National Assembly adopted the Bill amending and modifying the Republic of Serbia 2012 Budget Law. The National Assembly also adopted the proposals of decisions granting consent to the decisions amending and modifying the financial plans for 2012 of the Republic Pension and Disability Insurance Fund, the Republic Health Insurance Fund and the National Employment Service, by a majority of votes.
On Voting Day, by a majority of votes, the National Assembly adopted the Bill amending and modifying the Budget System Law, Bill amending the Pension and Disability Insurance Law and the Bill Establishing Maximum Earnings in the Public Sector.
The Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia and the Government of the People’s Democratic Republic of Algeria, Bill on the Confirmation of the Memorandum of Understanding between the Government of the Republic of Serbia and the United Nations on the contribution to the United Nations Stand-By Arrangements System, Bill on the Confirmation of the Proposal of Amendments to the International Monetary Fund Statute on the reform of the Executive Board and the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Moldova on readmission or persons residing illegally and the Protocol on the implementation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Moldova on readmission or persons residing illegally were also adopted by a majority of votes.
By a majority of votes, the National Assembly adopted the Proposal for the Election of Vice Governors of the National Bank of Serbia and the Proposal of the Decision on the election of the Council of the State Audit Institution.
Following the adoption of the Proposal of the Decision on the election of the Council of the State Audit Institution, the President, Vice President and members of the Council of the State Audit Institution took the oath of office before the National Assembly.
In the continuation, the National Assembly adopted the Proposals of the Decisions amending the Decision on the election of members and deputy members of the committees of the National Assembly of the Republic of Serbia and the Proposal of the Decision amending the Decision on the establishment of the composition of the standing delegations of the National Assembly of the Republic of Serbia to international parliamentary institutions, by a majority of votes.
On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the session and decided that none of the provisions of the Rules of Procedure had been violated.
As the National Assembly had completed the discussion on all the items on the agenda and ruled on them, National Assembly Speaker MA Nebojsa Stefanovic concluded the Ninth Extraordinary Session of the National Assembly of the Republic of Serbia in 2012.
