Fourth Sitting of the Defence and Internal Affairs Committee

At the sitting held on 28 December, the members of the Defence and Internal Affairs Committee considered the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Bulgaria amending the Police Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Bulgaria.


The Bill was presented by Jana Ljubicic, State Secretary at the Ministry of the Interior. The Police Cooperation Agreement between Serbia and Bulgaria which came into force on 1 December 2010 has run into certain difficulties in the implementation of provisions concerning mixed patrols. Namely, the Agreement stipulates that police officers in mixed patrols, when carrying out their duties, have to cross the border exclusively through official border crossings, while the places patrolled can sometimes be as much and 50 km away from the nearest border crossing. To overcome this problem, the final provisions of the Agreement stipulate that amendments and modifications to the Agreement can be made based on mutual written consent, but the exact manner has not been specified. Therefore, both sides deemed it acceptable to amend the Agreement by an exchange of notes, and the Serbian side accepted the verbal note extended by the Bulgarian side.

The Committee members went on to consider the Bill on the Confirmation of the Security Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Federal Republic of Germany.

Jana Ljubicic presented the Agreement signed on 22 March 2016 in Berlin, posed to come into force when the two sides inform one another in writing that the conditions have been met for it to come into force in accordance with their respective national legislations. Its implementation should contribute to the strengthening and further development of cooperation between the Republic of Serbia and the Federal Republic of Germany in the sphere of security, in particular the prevention and suppression of criminal offenses, organised and major crime, terrorism, illegal arms trafficking, illegal migration and cross-border smuggling of humans.

As item three on the agenda the Committee members considered the Bill on the Confirmation of the Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Poland in Combating Organised and Other Types of Crime. Jana Ljubicic said that the Agreement was signed on 7 November 2011 in Warsaw as both sides were willing to advance the operative cooperation on the suppression of organised and other types of crime through the framework of an international agreement. The Agreement stipulated that the contractual sides inform one another on the completed conduct of internal legal procedure.

The Committee members also considered the Government’s proposal for consent for the provisional implementation of the Agreement amending the Agreement between the Government of the Republic of Serbia and the Government of the Kingdom of Spain on mutual recognition and exchange of national driving licences until its coming into force. The Agreement concerns amendments to Annex I of the Agreement for the purpose of legislative harmonisation i.e. adjustment of the Law on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Kingdom of Spain on mutual recognition and exchange of national driving licences to the Law on Road Traffic Safety in the part concerning new driving licence categories, and to make it possible for Serbian nationals living in Spain to exchange their national driving licence for a Spanish one.

Following a debate on all four items on the agenda the Committee members decided, by majority vote, to propose that the National Assembly accept the bills. Committee Chairperson Marija Obradovic was selected to be the Committee rapporteur at the National Assembly sitting.
