At its fifth sitting, held on 22 September 2008, the Committee on Justice and Administration discussed the notice of the Grand Personnel Council on the termination of duties of judges at their personal request and due to mandatory retirement and adopted the Proposal of the Decision on the termination of judicial duty of 58 judges at their own request and 17 judges due to mandatory retirement.

Having been briefed on the decisions of the Grand Personnel Council on establishing the grounds for dismissal from judicial duty, the Committee adopted the Proposal of the Decision on the dismissal from judicial duty of one judge due to conviction of a criminal offense, one judge due to conviction of a punishable offense making him unfit for judicial duty and three judges due to unconscientious performance of judicial duties.

The Committee also adopted the Proposal of the Decision on the termination of duty at their own request, of two court presidents, as well as the Proposal of the Decision on the dismissal of two court presidents due to unconscientious performance of duties.

At the sitting, the Committee also discussed the notice of the High Judicial Council on the termination of duty of public prosecutors and adopted the Proposal of the Decision on the termination of public prosecutorial duty at their own request (12) and due to mandatory retirement.

The Committee discussed the decisions of the High Judicial Council on establishing the grounds for dismissal of the district and municipal public prosecutor and adopted the Proposal of the Decision on the dismissal of two public prosecutors due to incompetent and unconscientious performance of duties.

The Committee considered the decision of the Republic Public Prosecutor’s Office on establishing the grounds for dismissal of the Deputy Republic Public Prosecutor due to permanent loss of working capacity and adopted the Proposal of the Decision on the dismissal of the Deputy Republic Public Prosecutor.

The Committee concluded that all the proposals of decisions be forwarded to the National Assembly, proposing that they be discussed urgently. They also decided to submit the entire documentation to all the Committee members, i.e. elaborations of all the proposals for termination and dismissal of judicial and public prosecutorial duties.

Deputy Miroslav Petkovic was elected Committee Deputy Chairman at the sitting.
