Eighth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2020

The Speaker of the National Assembly of the Republic of Serbia Ivica Dacic convened the Eighth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2020, for Tuesday, 22 December 2020, starting at 10 am.


Before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Samir Tandir, Djordje Milicevic, Borisav Kovacevic, Milenko Jovanov and Dragan D. Markovic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly adopted the following agenda:

  1. Bill amending the Law on Civil Servants, submitted by the Government;
  2. Bill amending the Law on Public Service Employees, submitted by the Government;
  3. Bill amending the Law on Salary System of Public Sector Employees, submitted by the Government;
  4. Bill amending the Law on Salaries of Civil Servants and General Service Employees in Bodies of Autonomous Provinces and Local Self-Government Units, submitted by the Government;
  5. Bill amending the Law on Salaries of Employees of Public Agencies and Other Organizations Founded by the Republic of Serbia, Autonomous Province or Local Self-Government Unit, submitted by the Government;
  6. Bill on the Loan of the Republic of Serbia with the UniCredit Bank Srbija A.D. Beograd for the financing of project Ruma-Sabac-Loznica, submitted by the Government;
  7. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of Hong Kong Special Administrative Region of the People’s Republic of China on Elimination of Double Taxation with respect to Taxes on Income and Property and Prevention of Tax Evasion and Avoidance, submitted by the Government;
  8. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of France on Cooperation in Implementing Priority Projects in the Republic of Serbia, submitted by the Government;
  9. Bill on the Confirmation of the Memorandum of Understanding between the Government of the Republic of Serbia and the Government of the United Kingdom of Great Britain and Northern Ireland on the Employment of Family Members Sharing the Household of the Staff of Diplomatic and Consular Representative Offices, submitted by the Government;
  10. Proposal of the Decision on termination of office of President of the Republic Commission for Protection of Rights in Public Procurement Procedures, submitted by the Committee on Finance, State Budget and Control of Public Spending;
  11. Proposal of the Decision on termination of office of member of the Republic Commission for Protection of Rights in Public Procurement Procedures, submitted by the Committee on Finance, State Budget and Control of Public Spending;
  12. Proposal of the Decision on the election of President and one member of the Republic Commission for Protection of Rights in Public Procurement Procedures, submitted by the Committee on Finance, State Budget and Control of Public Spending;
  13. Proposal of the Decision on the election of members of the State Prosecutorial Council from the ranks of public prosecutors and deputy public prosecutors and from the ranks of faculty of law professors, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government;
  14. Proposal of the Decision on the election of High Judicial Council members from the ranks of judges, submitted by the High Judicial Council;
  15. Proposal of the Decision on the election of court presidents, submitted by the High Judicial Council;
  16. Proposal of the Decision on the election of court presidents, submitted by the High Judicial Council;
  17. Proposal of the Decision on the termination of office of President of the Appellate Court in Kragujevac and the President of the Commercial Court in Belgrade, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government;
  18. Proposal of the Decision on the termination of office of Public Prosecutor at the Basic Public Prosecutor’s Office in Novi Pazar, Basic Public Prosecutor’s Office in Lebane and Basic Public Prosecutor’s Office in Becej, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government, and
  19. Proposal of the Decision on the adoption of the Code of Conduct for MPs, submitted by the Committee on Administrative, Budgetary, Mandate and Immunity Issues.
The National Assembly accepted the proposal of MP Dr Aleksandar Martinovic to complete a joint debate in principle and single debate on items 1 to 9 and a joint single debate on items 10 to 18 on the agenda.

On behalf of the submitter, the bills listed as items 1 to 9 on the agenda were presented by Minister of Public Administration and Local Self-Government Marija Obradovic.

By the end of the day the National Assembly completed the joint debate in principle and single debate on items 1 to 9 on the agenda.

On the second day of the proceedings, 23 December 2020, the National Assembly conducted and concluded a joint single debate on items 10 to 18 on the agenda.

As the National Assembly had completed the debate on items 10 to 18 on the agenda, the Chair, National Assembly Deputy Speaker Dr Vladimir Orlic set Wednesday, 23 December 2020, as Voting Day on these items on the agenda, starting at 1.45 pm.

The National Assembly went on to commence a single debate on item 19 on the agenda - Proposal of the Decision on the adoption of the Code of Conduct for MPs, presented on behalf of the submitter by Dr Aleksandar Martinovic. He said that as representative of the submitter he accepted the eight amendments submitted by MP Dr Vladimir Orlic on 22 December 2020.

Voting Day on items 10 to 18 on the agenda

On Voting Day, 23 December 2020, the MPs unanimously passed the Proposal of the Decision on termination of office of President of the Republic Commission for Protection of Rights in Public Procurement Procedures, Proposal of the Decision on termination of office of member of the Republic Commission for Protection of Rights in Public Procurement Procedures and the Proposal of the Decision on the election of President and one member of the Republic Commission for Protection of Rights in Public Procurement Procedures.

The MPs also passed the Proposal of the Decision on the election of members of the State Prosecutorial Council from the ranks of public prosecutors and deputy public prosecutors and from the ranks of faculty of law professors and elected:

  • from the Republic Public Prosecutor’s Office: Branko Stamenkovic, Deputy Republic Public Prosecutor;
  • from appellate public prosecutor’s offices, Prosecutor’s Office for Organised Crime and Prosecutor’s Office for War Crimes: Milan Tkalac, Public Prosecutor at the Appellate Public Prosecutor’s Office in Novi Sad;
  • from higher public prosecutor’s offices: Tanja Vukicevic, Deputy Public Prosecutor at the Higher Public Prosecutor’s Office in Belgrade;
  • from basic public prosecutor’s offices: Boris Pavlovic, Deputy Public Prosecutor at the Third Basic Public Prosecutor’s Office in Belgrade, and Predrag Milovanovic, Deputy Public Prosecutor at the Second Basic Public Prosecutor’s Office in Belgrade
  • from public prosecutor’s offices from the territory of autonomous province: Branislav Ilic Jasanovic, Deputy Public Prosecutor at the Appellate Public Prosecutor’s Office in Novi Sad;
  • and for State Council member from the ranks of faculty of law professors: Dr Slobodan Orlovic, professor of the Faculty of Law of the University of Novi Sad.
The National Assembly went on to pass the Proposal of the Decision on the election of High Judicial Council members from the ranks of judges, electing: Zorana Delibasic, Marija Arandjelovic Juresa, Snezana Bjelogrlic, Zak Pavlovic and Vukica Kuzic.

The National Assembly passed the Proposal of the Decision on the election of court presidents, without disputed candidate Snezana Bjelogrlic whom the National Assembly could not accept as President of the Basic Court in Ivanjica because of the incompatibility with the post she had already been elected to in the meantime, and the Proposal of the Decision on the election of court presidents, without disputed candidate Zlatoje Ankic who was not elected President of the Basic Court in Zrenjanin.

The MPs also passed the Proposal of the Decision on the termination of office of President of the Appellate Court in Kragujevac and the President of the Commercial Court in Belgrade, and the Proposal of the Decision on the termination of office of Public Prosecutor at the Basic Public Prosecutor’s Office in Novi Pazar, Basic Public Prosecutor’s Office in Lebane and Basic Public Prosecutor’s Office in Becej.

The National Assembly went on to conduct a single debate on the Proposal of the Decision on the adoption of the Code of Conduct for MPs.

On the third day of the proceedings, 24 December 2020, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Milija Miletic, Nebojsa Bakarec and Zvonimir Stevic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly continued and completed the single debate on item 19 on the agenda.

As the National Assembly had completed the debate in principle and in detail on all the items on the agenda, the Chair, National Assembly Deputy Speaker Marija Jevdjic set Thursday, 24 December 2020, as Voting Day on items 1 to 9 and item 19 on the agenda of the Eighth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2020, starting at 2 pm.

Voting Day on items 1 to 9 and item 19 on the agenda

On Voting Day, 24 December 2020, by majority vote, the National Assembly passed the Bill amending the Law on Civil Servants, Bill amending the Law on Public Service Employees, Bill amending the Law on Salary System of Public Sector Employees, Bill amending the Law on Salaries of Civil Servants and General Service Employees in Bodies of Autonomous Provinces and Local Self-Government Units, and theBill amending the Law on Salaries of Employees of Public Agencies and Other Organizations Founded by the Republic of Serbia, Autonomous Province or Local Self-Government Unit.

The National Assembly also passed the Bill on the Loan of the Republic of Serbia with the UniCredit Bank Srbija A.D. As the National Assembly had completed the debate on all the items on the agenda and ruled on them, National Assembly Speaker Ivica Dacic concluded the Eighth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2020.
