59th Sitting of the Committee on the Judiciary, Public Administration and Local Self-Government

At the sitting held on 10 February, the members of the Committee on the Judiciary, Public Administration and Local Self-Government discussed, in principle, the Bill on remedying the consequences of seizure of assets of Holocaust victims with no living legal heirs, Bill amending and modifying the Law on Misdemeanours and the Bill amending the Law on Organisation of Courts.


The Committee members completed a joint debate in principle on all three bills, which were elaborated by representatives of the Ministry of Justice.

Presenting the Bill on remedying the consequences of seizure of assets of Holocaust victims with no living legal heirs, the representatives of the Ministry of Justice said that in the implementation of the Law on restitutions in became apparent that in certain cases there is no active legitimation i.e. there are no living heirs to the proprietors of the seized assets to claim them, so the present Bill needs to be passed to remedy this situation.

The Bill amending and modifying the Law on Misdemeanours raises the threshold for misdemeanours that the institute of misdemeanour order can be issued for. Since the institute of misdemeanour order, introduced by the 2014 Law on Misdemeanours, has given good results, the Bill raises the fixed amount fine for physical and legal entities. Among other things, the Bill states that AP Vojvodina and local self-governments can issue fixed amount misdemeanour orders, it simplifies the ruling in second instance proceedings and improves the delivery of misdemeanour orders.

The Bill amending the Law on Organisation of Courts amends one article, concerning the delay of the implementation of the basic Law, at the initiative of the High Judicial Council.

In the ensuing debate the Committee members asked for the list of property requested by the Jewish community and opined that the Bill on remedying the consequences of seizure of assets of Holocaust victims with no living legal heirs would be a vindication of a kind.

The Committee members proceeded to unanimously accept all three bills in principle.

The sitting was chaired by Committee Chairman Petar Petrovic and attended by Committee members and deputy members Vuceta Toskovic, Mirjana Andric, Zivan Djurisic, Velinka Tosic, Tanja Tomasevic Damnjanovic, Nedjo Jovanovic, Meho Omerovic and Biljana Savovic.
