23rd Sitting of the Committee on Constitutional and Legislative Issues

At the sitting held on 27 December, the members of the Committee on Constitutional and Legislative Issues considered the amendments submitted to items 1 to 15 for the Seventh Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2016.


The MPs had submitted 28 amendments to the Bill amending and modifying the Law on Salary System of Public Sector Employees. The Committee found 27 of them compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 2 by MPs Vjerica Radeta, Natasa Jovanovic and Nemanja Sarovic was rejected as incomplete.

Out of the 17 amendments submitted to the Bill amending the Law on Public Media Services, 16 were found to be compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 2 by MPs Milorad Mircic, Zoran Krasic and Bozidar Delic was rejected as incomplete.

Out of the 18 amendments submitted to the Bill amending the Law on Temporary Regulation of Payment of Fees for the Public Media Service, 17 were found to be compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 2 by MPs Nemanja Sarovic, Zoran Krasic and Momcilo Mandic was rejected as incomplete.

The MPs had submitted 15 amendments to the Bill amending and modifying the Law on Organisation of Courts. The Committee found 14 of them compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 2 by MPs Vjerica Radeta, Sreto Peric and Ljiljana Mihajlovic was found to be non-compliant with the Constitution and the legal system of the Republic of Serbia.

Of the 118 amendments to the Bill amending and modifying the Law on Capital Market, 117 were found to be compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 21 by MPs Zoran Krasic, Vjerica Radeta and Marina Ristic was rejected as incomplete.

The MPs had submitted 149 amendments to the Bill amending and modifying the Law on Takeover of Joint Stock Companies. The Committee found 148 of them compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 27 by MPs Zoran Krasic, Vjerica Radeta and Tomislav Ljubenovic was rejected as incomplete.

The MPs had submitted 24 amendments to the Bill amending and modifying the Law on Public Property. The Committee rejected the amendment submitted to Article 3 by MPs Zoran Krasic, Vjerica Radeta and Ljiljana Mihajlovic as incomplete. The remaining 23 amendments were found to comply with the Constitution and the legal system of the Republic of Serbia.

The MPs had submitted 178 amendments to the Bill amending and modifying the Excise Tax Law. The Committee found 177 of them compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 27 by MPs Zoran Krasic, Vjerica Radeta and Miljan Damjanovic was rejected as incomplete.

The MPs had submitted 96 amendments to the Bill amending and modifying the Value Added Tax Law. The Committee found 95 of them compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 15 by MPs Zoran Krasic, Vjerica Radeta and Aleksandra Belacic was rejected as incomplete.

The MPs had submitted 142 amendments to the Bill amending and modifying the Law on Tax Procedure and Tax Administration. The Committee rejected the amendment submitted to Article 26 by MPs Zoran Krasic, Vjerica Radeta and Milorad Mircic as incomplete, while the remaining 141 were found to comply with the Constitution and the legal system of the Republic of Serbia.

The MPs had submitted 34 amendments to the Bill on Assumption of Obligations of “HIP – Petrohemija”, Pancevo, JSC for production of petrochemical products, raw materials and chemicals toward the Petroleum Industry of Serbia a.d. Novi Sad and Transformation of Said Obligations into the Public Debt of the Republic of Serbia. The Committee found 33 of them compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 6 by MPs Zoran Krasic, Vjerica Radeta and Miroslava Stankovic Djuricic was rejected as incomplete.

The Committee found all 207 amendments submitted to the Bill amending and modifying the Customs Law compliant with the Constitution and the legal system of the Republic of Serbia.

The MPs had submitted 291 amendments to the Bill on Real Estate Appraisers. The Committee found 290 of them compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 2 by MPs Zoran Krasic, Vjerica Radeta and Miljan Damjanovic was rejected as incomplete.

The MPs had submitted 17 amendments to the Bill amending and modifying the Law on the Settlement of Public Debt of the Federal Republic of Yugoslavia arising from Citizens’ Foreign Exchange Savings. The Committee found 16 of them compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 2 by MPs Zoran Krasic, Vjerica Radeta and Momcilo Mandic was rejected as incomplete.

The MPs had submitted 90 amendments to the Bill on the Settlement of Public Debt of the Republic of Serbia arising from Unpaid Citizens’ Foreign Exchange Savings Deposited in Banks with Headquarters on the Territory of the Republic of Serbia and Branch Offices on the Territory of Former SFRY Republics. The Committee found 89 of them compliant with the Constitution and the legal system of the Republic of Serbia, while the amendment submitted to Article 2 by MPs Zoran Krasic, Vjerica Radeta and Jovo Ostojic was rejected as incomplete.

The Committee on Constitutional and Legislative Issues went on to review the four amendments submitted by the Committee on Finance, State Budget and Control of Public Spending to articles 2, 6, 9 and 10 of the Bill amending and modifying the Excise Tax Law and unanimously declared them compliant with the Constitution and the legal system of the Republic of Serbia.

The Committee also found the amendment submitted by the Committee on Finance, State Budget and Control of Public Spending to Article 25 of the Bill amending and modifying the Law on Tax Procedure and Tax Administration compliant with the Constitution and the legal system of the Republic of Serbia. The Committee proceeded to find the amendments submitted to articles 6 and 12 of the Bill amending and modifying the Value Added Tax Law as well as the amendment to Article 40 of the Bill amending and modifying the Customs Law, by the Committee on Finance, State Budget and Control of Public Spending, compliant with the Constitution and the legal system of the Republic of Serbia.

The sitting was chaired by Committee Chairman Djordje Komlenski, and attended by the following Committee members and deputy members: Aleksandra Majkic, Miroljub Stankovic, Vesna Markovic, Krsto Janjusevic, Srbislav Filipovic, Bojan Torbica, Balint Pasztor and Jelena Zaric Kovacevic.
