16th Sitting of the Committee on Constitutional and Legislative Issues

At the sitting held on 16 December, the members of the Committee on Constitutional and Legislative Issues provided opinions to the Constitutional Court regarding the initiative to launch:


  1. The procedure to assess the constitutionality of the provision of Article 6, paragraphs 2 and 3, and Article 13, paragraph 2, of the Law on Conversion of Right of Use into Ownership Right of Construction Land for a Fee, and provision of articles 3, 6 (paragraphs 2 and 3), 7 (paragraphs 1, 2 and 3), 8, 13, (paragraph 2), 18 and 20 of the Law on Conversion of Right of Use into Ownership Right of Construction Land for a Fee;
  2. The procedure to assess the constitutionality and compliance with ratified international agreements of the provisions of Article 32, paragraphs 2, 3 and 4, and Article 85, paragraph 1, item 6) of the Law on Protection of Citizens Against Infectious Diseases;
  3. The procedure to assess the constitutionality of the provision of Article 6, paragraph 5, item 6) of the Law on Road Transport of Goods;
  4. The procedure to assess the constitutionality of the provisions of Article 36, paragraphs 3 and 4 of the Law on Tax Procedure and Tax Administration;
  5. The procedure to assess the compliance of the provision of Article 5, paragraph 2 of the Law on Public Utilities with the Constitution of the Republic of Serbia.
The Committee also considered the amendments submitted to the Bill on Management of Airports, Bill on Housing and Building Maintenance, Bill on Transport of Dangerous Goods, Bill amending and modifying the Law on Public Utilities and the Bill amending and modifying the Law on Public-Private Partnership and Concessions.

The Committee found the amendment submitted to Article 18 of the Bill on Management of Airports non-compliant with the Constitution and the legal system of the Republic of Serbia, while the remaining 59 amendments did comply with the Constitution and the legal system of the Republic of Serbia.

Of the 462 amendments submitted to the Bill on Housing and Building Maintenance, the Committee members rejected as incomplete the amendment to Article 1 of the Bill, while the amendments submitted to articles 9, 14, 31 and 41 with correction, were found to be non-compliant with the Constitution and the legal system of the Republic of Serbia. The remaining amendments were found to comply with the Constitution and the legal system of the Republic of Serbia.

The Committee found the amendment submitted to Article 61 of the Bill on Transport of Dangerous Goods non-compliant with the Constitution and the legal system of the Republic of Serbia, while the rest of the amendments were found to be compliant.

The Committee also rejected as incomplete two of the amendments submitted to the Bill amending and modifying the Law on Public Utilities - the first calling to add a subheading and Article 4a after Article 4, and the amendment to Article 66, while the remaining amendments were found to comply with the Constitution and the legal system of the Republic of Serbia.

The Committee members found all the amendments submitted to the Bill amending and modifying the Law on Public-Private Partnership and Concessions compliant with the Constitution and the legal system of the Republic of Serbia.

The Committee proceeded to consider the amendments submitted by the Committee on Spatial Planning, Transport, Infrastructure and Telecommunications and found the amendments to articles 7, 15 and 20 of the Bill on Management of Airports, to articles 3, 11, 88, 91, 141, subheading over Article 150 and Article 151 of the Bill on Housing and Building Maintenance, to articles 20, 27, 80 and 81 of the Bill on Transport of Dangerous Goods, and to articles 9, 14 and 16 of the Bill amending and modifying the Law on Public Utilities to be compliant with the Constitution and the legal system of the Republic of Serbia.

The sitting was chaired by Committee Chairman Djordje Komlenski, and attended by the following Committee members and deputy members: Aleksandra Majkic, Vesna Nikolic Vukajlovic, Krsto Janjusevic, Bojan Torbica, Balint Pasztor, Jelena Zaric Kovacevic, Vesna Markovic and Aleksandar Markovic.
