Third Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2010 The Speaker of the National Assembly of the Republic of Serbia, Prof. Dr Slavica Djukic-Dejanovic, convened the Third Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2010, for Thursday, 14 October 2010, starting at 3 p. m.



Third Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2010

The Speaker of the National Assembly of the Republic of Serbia, Prof. Dr Slavica Djukic-Dejanovic, convened the Third Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2010, for Thursday, 14 October 2010, starting at 3 p.m.

The sitting commenced at 8:25 p.m.

The National Assembly set the following agenda:

1. The Bill amending and modifying the Health Care Law, submitted by the Government;

2. The Proposal of the Decision on Plan of Health Care Development in the Republic of Serbia, submitted by the Government;

3. The Bill on the Spatial Plan of the Republic of Serbia from 2010 to 2020, submitted by the Government;

4. The Bill amending and modifying the Law on Chemicals, submitted by the Government;

5. The Bill amending and modifying the Law on Biocides, submitted by the Government;

6. The Bill amending and modifying the Law on Strategic Environmental Impact Assessment, submitted by the Government;

7. The Bill amending and modifying the Law on Environmental Noise Protection, submitted by the Government;

8. The Bill amending and modifying the Law on Environmental Protection, submitted by the Government;

9. The Bill amending and modifying the Law on Waste Management, submitted by the Government;

10. The Bill amending and modifying the Law on Meteorological and Hydrological Activities, submitted by the Government;

11. The Bill amending and modifying the Law on Tourism, submitted by the Government;

12. The Bill amending and modifying the Law on Employment and Insurance in Case of Unemployment, submitted by the Government;

13. The Bill amending and modifying the Law on the Export Credit and Insurance Agency of the Republic of Serbia, submitted by the Government;

14. The Bill amending and modifying Law on the Republic of Serbia Development Fund, submitted by the Government;

15. The Bill on Hazardous Cargo Transportation, submitted by the Government;

16. The Bill on Legacies and Foundations, submitted by the Government;

17. The Bill on the indebtedness of the Republic of Serbia at KBC Banka a.d. Beograd, Nova Kreditna banka Maribor d.d., EUROBANK EFG a.d. Beograd, Vojvodjanska banka a.d. Novi Sad, Hypo-Alpe-Adria Bank a.d. Beograd and Erste Bank a.d. Novi Sad and at BANCA INTESA a.d. Beograd, UniCredit Bank Serbia a.d. Beograd, Raiffeisen bank a.d. Beograd and Societe Generale Bank Serbia a.d. Beograd which gave a joint offer, submitted by the Government;

18. The Bill Granting Guarantee by the Republic of Serbia in favour of Societe Generale Bank Serbia a.d. Beograd and UniCredit Bank Serbia a.d. Beograd under the debt of JAT AIRWAYS a.d. Beograd air transport joint stock company, submitted by the Government;

19. The Bill on the Confirmation of the Framework Agreement between the Government of the Republic of Serbia and the Government of the People’s Republic of China on securing the People’s Republic of China’s concessional loan for the Republic of Serbia, submitted by the Government;

20. The Bill on the Confirmation of the State Concessional Loan Agreement for Project NUCTECHTM system for the inspection of containers/vehicles between the Government of the Republic of Serbia as borrower and Chinese Export Import Bank as creditor, submitted by the Government;

21. The Bill on the Confirmation of the Amendments to the Convention Establishing a Customs Co-operation Council, submitted by the Government;

22. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Ukrainian Cabinet of Ministers on mutual assistance in customs matters, submitted by the Government;

23. The Bill on the Confirmation of the Protocol between the Government of the Republic of Serbia and the Government of the Czech Republic to the Economic Cooperation Agreement between the Council of Ministers of Serbia and Montenegro and the Government of the Czech Republic, submitted by the Government;

24. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Czech Republic amending and modifying the Agreement between the Federal Government of the Federal Republic of Yugoslavia and the Government of the Czech Republic on mutual stimulation and protection of investment, signed on 13 October 1997, submitted by the Government;

25. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Malta on mutual stimulation and protection of investment, submitted by the Government;

26. The Bill on the Confirmation of the Trade and Economic Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Azerbaijan, submitted by the Government (No. 335-1690/10 of 18 June 2010);

27. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Council of Ministers of Bosnia and Herzegovina on cooperation in the sphere of tourism, submitted by the Government;

28. The Bill on the Confirmation of the Economic, Technical and Scientific Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Arab Republic of Egypt, submitted by the Government;

29. The Bill on the Confirmation of the Agreement on cooperation in the sphere of tourism between the Government of the Republic of Serbia and the Government of the Arab Republic of Egypt, submitted by the Government;

30. The Bill on the Confirmation of the Air Transportation Agreement between the Government of the Republic of Serbia and the Government of the Arab Republic of Egypt, submitted by the Government;

31. The Bill on the Confirmation of the Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Russian Federation in the sphere of humanitarian reactions in emergency situations, prevention of natural disasters and technogenic accidents and elimination of their consequences, submitted by the Government;

32. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Azerbaijan on cooperation in the fight against crime, submitted by the Government;

33. The Bill on the Confirmation of the Police Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Bulgaria, submitted by the Government;

34. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Bulgaria on the establishment and functioning of a joint contact centre for police and customs cooperation, submitted by the Government;

35. The Proposal of the Decision Granting Consent to the Rulebook on Internal Organisation and Job Systematisation at the Support Service of the Equality Commissioner, submitted by the Justice and Administration Committee of the National Assembly of the Republic of Serbia;

36. The Proposal of the Decision Granting Consent to the Decision on the Establishment and Work of the Support Service of the Equality Commissioner, submitted by the Justice and Administration Committee of the National Assembly of the Republic of Serbia.

By a majority of votes, the National Assembly decided to conduct a joint discussion in principle and unified discussion on items 1 and 2 on the agenda; joint discussion in principle on items 4, 5, 6, 7, 8, 9 and 10 on the agenda; joint discussion in principle on items 11, 12, 13 and 14 on the agenda; joint discussion in principle and unified discussion on items 15 and 30 on the agenda; joint discussion in principle and unified discussion on items 17 through 22 on the agenda; joint unified discussion on items 23 through 29 on the agenda; joint unified discussion on items 31 through 34 on the agenda. In addition, the National Assembly shall conduct a joint unified discussion on items 35 and 36 on the agenda.

On the second day of work, 19 October, the National Assembly conducted and concluded a joint debate in principle and unified debate on the Bill amending and modifying the Health Care Law and Proposal of the Decision on Plan of Health Care Development in the Republic of Serbia, explained by Minister of Health Prof. Dr Tomica Milosavljevic, representative of the submitter.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups Milos Aligrudic, Velimir Ilic, Zoran Ostojic and Boris Aleksic requested information and explanations in line with article 286 of the National Assembly Rules of Procedure.

In line with article 101 of the National Assembly Rules of Procedure, National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic adjourned the proceedings of the Third Sitting of the Second Regular Session because of the Fourth Sitting of the Second Regular Session in 2010 convened for Wednesday 20 October 2010 at 10 a.m.

The sitting was convened due to the urgency of the Bills on its agenda. The Third Sitting of the Second Regular Session will be continued after the conclusion of the Fourth Sitting of the Second Regular Session.


On the third day of work, 26 October, the National Assembly conducted and concluded a debate in principle on the Bill on the Spatial Plan of the Republic of Serbia from 2010 to 2020, elaborated by Minister of Environment and Spatial Planning Oliver Dulic, representative of the submitters.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups Nikola Krpic, Nebojsa Randjelovic, Jovan Damjanov, Nemanja Sarovic, Zoran Nikolic and Velimir Ilic requested information and explanations in line with article 286 of the National Assembly Rules of Procedure.


On the fourth day of work, 27 October, the National Assembly continued the session with a joint debate in principle on the Bill amending and modifying the Law on Chemicals, Bill amending and modifying the Law on Biocides, Bill amending and modifying the Law on Strategic Environmental Impact Assessment, Bill amending and modifying the Law on Environmental Noise Protection, Bill amending and modifying the Law on Environmental Protection, Bill amending and modifying the Law on Waste Management and the Bill on Meteorological and Hydrological Activities.

Minister of Environment and Spatial Planning Oliver Dulic explained the Bills to the deputies.

At the Administrative Committee’s proposal, the National Assembly went on to note the termination of the term of office of deputy Snezana Stojanovic-Plavsic, elected from the For European Serbia - Boris Tadic electoral list, before the expiration of the term she was elected to.

Also at the Administrative Committee’s proposal, the National Assembly noted the existence of sufficient grounds to verify the term of office of deputy Elizabet Paunovic, elected from the For European Serbia - Boris Tadic electoral list.

By the end of the day the National Assembly had completed the joint debate in principle on items 4, 5, 6, 7, 8, 9 and 10 on the agenda.


On the fifth day of work, 28 October, the National Assembly commenced a joint debate in principle on the Bill amending and modifying the Law on Tourism, Bill amending and modifying the Law on Employment and Insurance in Case of Unemployment, Bill amending and modifying the Law on the Export Credit and Insurance Agency of the Republic of Serbia and the Bill amending and modifying the Law on the Republic of Serbia Development Fund. The Bills were elaborated by Verica Kalanovic, Minister for National Investment Plan.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups Milos Aligrudic, Aleksandar Martinovic, Nada Kolundzija, Jovan Damjanovic and Velimir Ilic requested information and explanations in line with article 286 of the National Assembly Rules of Procedure.

Until recess, the National Assembly conducted the joint debate in principle on the Bills. The debate was called to a stop as, under article 205 of the Rules of Procedure, every last Thursday in the month is the day the deputies ask the Government questions, in the presence of Government members.


On the sixth day of work, 2 November, the National Assembly continued the joint debate in principle on items 11 through 14 on the agenda: the Bill amending and modifying the Law on Tourism, Bill amending the Law on Employment and Insurance in Case of Unemployment, Bill amending and modifying the Law on the Export Credit and Insurance Agency of the Republic of Serbia and Bill amending and modifying the Law on the Republic of Serbia Development Fund.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups Nebojsa Randjelovic, Milica Vojic-Markovic, Nemanja Sarovic and Zlata Djeric requested information and explanations in line with article 286 of the National Assembly Rules of Procedure.

National Assembly Deputy Speaker Gordana Comic informed the deputies that part of the sitting was being observed from the gallery of the National Assembly House Great Hall, by a group of students of the Kragujevac Law Faculty and greeted them on the behalf of the deputies.

In the morning part of the proceedings the National Assembly concluded the joint debate in principle on the Bill amending and modifying the Law on Tourism, Bill amending the Law on Employment and Insurance in Case of Unemployment, Bill amending and modifying the Law on the Export Credit and Insurance Agency of the Republic of Serbia and the Bill amending and modifying the Law on the Republic of Serbia Development Fund.

The National Assembly went on to conduct and conclude a joint debate in principle and unified debate on the Bill on Hazardous Cargo Transportation and Bill on the Confirmation of the Air Transportation Agreement between the Government of the Republic of Serbia and the Government of the Arab Republic of Egypt.


On the seventh day of work, 3 November, the National Assembly continued the session by a debate in principle on the Bill on Legacies and Foundations.

The Bill was elaborated by Minister of Culture Nebojsa Bradic.

By the end of the day the National Assembly had completed the debate in principle on the Bill on Legacies and Foundations.


At the beginning of the proceedings on the eighth day, 4 November, the heads i.e. authorised representatives of the Deputy Groups Judita Popovic, Vjerica Radeta, Radojko Obradovic and Miroslav Markicevic requested information and explanations in line with article 286 of the National Assembly Rules of Procedure.

In the continuation, the Chair, National Assembly Deputy Speaker Gordana Comic consulted with the heads, deputy heads or authorised representatives of the deputy clubs considering that the expected representative of the submitters was absent due to illness and the Government had not sent another authorised representative. Following the completion of the meeting, the Chair informed the deputies of the conclusion adopted at the consultation with the heads, deputy heads or authorised representatives of the deputy groups, that the National Assembly was to continue work on Tuesday, 9 November 2010, at 10 a.m.


On the ninth day of work, 9 November, the National Assembly conducted and concluded a joint unified debate on items 17 through 22 on the agenda. The six Bills on Serbia’s loans with commercial banks were elaborated by Minister of Finance Diana Dragutinovic.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups Vladimir Milentijevic, Jovan Damjanovic, Dragan Sormaz, Zoran Ostojic, Jorgovanka Tabakovic and Paja Momcilov requested information and explanations in line with article 286 of the National Assembly Rules of Procedure.

In the morning part of the session the National Assembly commenced a joint unified debate on items 23 through 29 on the agenda. The Bills on the confirmation of several economic agreements and protocols between the Government of the Republic of Serbia and other states were presented by the Minister for National Investment Plan Verica Kalanovic.


On the tenth day of work, 10 November, the National Assembly continued the joint unified debate on items 23 through 29 on the agenda and in the morning part of the session concluded the debate on these Bills.

After recess, the National Assembly completed a joint unified debate on items 31, 32, 33 and 34 on the agenda.


On the eleventh day of work, 11 November, the National Assembly conducted and concluded a joint unified debate on the Proposal of the Decision Granting Consent to the Rulebook on Internal Organisation and Job Systematisation at the Support Service of the Equality Commissioner and the Proposal of the Decision Granting Consent to the Decision on the Establishment and Work of the Support Service of the Equality Commissioner, submitted by the Justice and Administration Committee of the National Assembly of the Republic of Serbia.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups Riza Halimi, Zoran Ostojic, Milos Aligrudic, Nikola Krpic and Boris Aleksic requested information and explanations in line with article 286 of the National Assembly Rules of Procedure.

After recess, the National Assembly completed a debate on the particulars on the Bill amending and modifying the Health Care Law.


On the twelfth day of work, 16 November, the National Assembly conducted and concluded a debate on the particulars on the Bill on the Spatial Plan of the Republic of Serbia from 2010 to 2020.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups Nikola Krpic, Cedomir Jovanovic, Zeljko Tomic, Velimir Ilic and Boris Aleksic requested information and explanations in line with article 286 of the National Assembly Rules of Procedure.

After recess, the National Assembly conducted and concluded a debate on the particulars on the seven environmental Bills: the Bill amending and modifying the Law on Chemicals, Bill amending and modifying the Law on Biocides, Bill amending and modifying the Law on Strategic Environmental Impact Assessment, Bill amending and modifying the Law on Environmental Noise Protection, Bill amending and modifying the Law on Environmental Protection, Bill amending and modifying the Law on Waste Management and Bill on Meteorological and Hydrological Activities.

On the thirteenth day of work, 17 November, the National Assembly continued the session with a debate on the particulars on the Bills amending and modifying the Law on Tourism, amending the Law on Employment and Insurance in Case of Unemployment, amending and modifying the Law on the Export Credit and Insurance Agency of the Republic of Serbia and amending and modifying Law on the Republic of Serbia Development Fund.

By the end of the day, the National Assembly had concluded the debate on the particulars on the Bills.

On the fourteenth day of work, 18 November, the National Assembly conducted and concluded a debate on the particulars on the Bill on Hazardous Cargo Transportation, Bill on Legacies and Foundations, Bill on the indebtedness of the Republic of Serbia at KBC Banka a.d. Beograd, Nova Kreditna banka Maribor d.d., EUROBANK EFG a.d. Beograd, Vojvodjanska banka a.d. Novi Sad, Hypo-Alpe-Adria Bank a.d. Beograd and Erste Bank a.d. Novi Sad and at BANCA INTESA a.d. Beograd, UniCredit Bank Serbia a.d. Beograd, Raiffeisen bank a.d. Beograd and Societe Generale Bank Serbia a.d. Beograd which gave a joint offer and Bill Granting Guarantee by the Republic of Serbia in favour of Societe Generale Bank Serbia a.d. Beograd and UniCredit Bank Serbia a.d. Beograd under the debt of JAT AIRWAYS a.d. Beograd air transport joint stock company.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups Nemanja Sarovic, Ivan Andric and Zlata Djeric requested information and explanations in line with article 286 of the National Assembly Rules of Procedure.

The Chair, National Assembly Deputy Speaker Gordana Comic informed the deputies that part of the sitting was being observed from the gallery of the Great Hall of the National Assembly House by the scholarship recipients of the Coordination Body of the Government of the Republic of Serbia for the Municipalities of Presevo, Bujanovac and Medvedja as part of their visit to the National Assembly and greeted them on the behalf of the deputies.

Since the National Assembly had completed the discussion on all the items on the agenda, the Chair, National Assembly Deputy Speaker Gordana Comic set Tuesday, 23 November 2010, as Voting Day on the items on the agenda for the Third Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2010, starting at 11 a.m.


Voting Day

On Voting Day, 23 November, the National Assembly adopted the 36 Bills and other documents on the agenda by a majority of votes.

The National Assembly ruled on the violation of article 107 of the Rules of Procedure that a deputy complained of during the sitting and decided that the abovementioned article of the Rules of Procedure had not been violated.

As the National Assembly had completed the discussion on all the items on the agenda and ruled on them, National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic concluded the Third Sitting of the Second Regular Session of the National Assembly in 2010.
