Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013

National Assembly Deputy Speaker Konstantin Arsenovic convened the Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013, for Tuesday, 3 December 2013, starting at 10 am.


The National Assembly adopted the following agenda:

1. Bill amending and modifying the Budget System Law, submitted by the Government,
2. Bill amending the Law on Pension and Disability Insurance, submitted by the Government,
3. Bill amending and modifying the Personal Income Tax Law, submitted by the Government,
4. Bill amending and modifying the Tobacco Law, submitted by the Government,
5. Bill amending the Value Added Tax Law, submitted by the Government,
6. Bill amending and modifying the Corporate Income Tax Law, submitted by the Government,
7. Bill amending and modifying the Law on Tax Procedure and Tax Administration, submitted by the Government,
8. Bill amending and modifying the Law on Contributions for Mandatory Social Security Insurance, submitted by the Government,
9. Bill amending and the Law on Salaries of Civil Servants and Employees, submitted by the Government,
10. Bill on Reduction of Net Wages for Public Sector Employees, submitted by the Government,
11. Bill amending the Law on Property Restitution and Compensation, submitted by the Government,
12. Republic of Serbia 2014 Budget Bill with its accompanying Proposal of the Decision granting consent to the Republic Pension and Disability Insurance Fund 2014 Financial Plan, Proposal of the Decision granting consent to the Republic Health Insurance Fund 2014 Financial Plan, Proposal of the Decision granting consent to the Fund for Social Insurance of Military Insured 2014 Financial Plan and the Proposal of the Decision granting consent to the National Employment Service 2014 Financial Plan, submitted by the Government,
13. Proposal of the Decision granting consent to the Decision amending and modifying the Republic Health Insurance Fund 2013 Financial Plan, submitted by the Government,
14. Proposal of the Decision granting consent to the Decision amending and modifying the National Employment Service 2013 Financial Plan, submitted by the Government,
15. Proposal of the Resolution on the Role of the National Assembly and Principles in the Negotiations on the Accession of the Republic of Serbia to the European Union, submitted by a group of 13 MPs,
16. Proposal of Authentic Interpretation of Provision of Article 2, Line Second of the Law on the Anti-Corruption Agency, submitted by the Committee on Constitutional and Legislative Issues of the National Assembly,
17. Ruling on the Proposal to Adopt an Authentic Interpretation of Provision of Article 7, Paragraph 1 of the Law on the Anti-Corruption Agency, submitted by MP Zoran Babic,
18. Proposal of the Decision amending the Decision on the Election of Member and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Socialist Party of Serbia Parliamentary Group,
19. Proposal of the Decision modifying the Decision on the Election of Member and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Democratic Party Parliamentary Group,
20. Proposal of the Decision amending the Decision on the Appointment of Heads of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, submitted by National Assembly Speaker Dr Nebojsa Stefanovic.

By a majority of votes, the National Assembly decided to complete a joint debate in principle on items 1 through 11 on the proposed agenda, joint debate in principle and single debate on items 12, 13 and 14 on the proposed agenda, joint single debate on items 16 and 17 on the proposed agenda and a joint single debate on items 18, 19 and 20 on the proposed agenda.

At the beginning of the proceedings, the Chair, National Assembly Deputy Speaker Konstantin Arsenovic greeted, on the behalf of the MPs and himself, the representatives and the members of the National Organisation of Persons with Disabilities following the sitting from the gallery of the Grand Hall and reminded everybody that 3 December is International Day of Persons with Disabilities.

Before the agenda was established, the heads i.e. authorised representatives of the parliamentary groups, MPs Gordana Comic, Zaharije Trnavcevic, Zoran Ostojic, Milica Vojic Markovic, Radmila Gerov, Suzana Grubjesic, Sasa Dujovic and Marija Obradovic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

Before recess, the MPs were addressed by Minister of Finance Lazar Krstic on the joint debate in principle on items 1 through 11 on the proposed agenda.

In line with article 101, paragraph 1 of the National Assembly Rules of Procedure, the Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013 was adjourned in order to hold the Eighth Special Sitting of the National Assembly of the Republic of Serbia in 2013.

After the completion of the Eighth Special Sitting of the National Assembly of the Republic of Serbia in 2013, the National Assembly continued the proceedings with a joint debate in principle on items 1 through 11 on the proposed agenda.

The National Assembly conducted the joint debate in principle on items 1 through 11 on the proposed agenda for the remainder of the day.

On the second day of the proceedings, 4 December, the National Assembly conducted and concluded the joint debate in principle on the bills listed as items 1 through 11 on the proposed agenda.

On the third day of the proceedings, 6 December, the National Assembly commenced and, by the end of the day, concluded a debate in detail on items 1 through 11 on the agenda for the sitting.

The Chair, National Assembly Speaker Dr Nebojsa Stefanovic asked the MPs to pay respects to the distinguished human rights activist Nelson Mandela with a minute of silence.

As the National Assembly had concluded the debate in principle and in detail on the first 11 items on the agenda for the sitting, the Chair, National Assembly Speaker Dr Nebojsa Stefanovic, reminded the MPs of the provision of article 87, paragraph 5, of the National Assembly Rules of Procedure according to which the National Assembly Speaker may set a Voting Day on a bill immediately after it has been discussed. In accordance with the provision, National Assembly Speaker Dr Nebojsa Stefanovic, set Friday, 6 December 2013, at 10.07 pm, as Voting Day on the first 11 items on the agenda for the Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013 viz. Bill amending and modifying the Budget System Law, Bill amending the Law on Pension and Disability Insurance, Bill amending and modifying the Personal Income Tax Law, Bill amending and modifying the Tobacco Law, Bill amending the Value Added Tax Law, Bill amending and modifying the Corporate Income Tax Law, Bill amending and modifying the Law on Tax Procedure and Tax Administration, Bill amending and modifying the Law on Contributions for Mandatory Social Security Insurance, Bill amending and the Law on Salaries of Civil Servants and Employees, Bill on Reduction of Net Wages for Public Sector Employees and the Bill amending the Law on Property Restitution and Compensation.

Voting Day

On Voting Day, 6 December, by a majority of MPs’ votes, the National Assembly adopted the Bill amending and modifying the Budget System Law, Bill amending the Law on Pension and Disability Insurance, Bill amending and modifying the Personal Income Tax Law, Bill amending and modifying the Tobacco Law, Bill amending the Value Added Tax Law, Bill amending and modifying the Corporate Income Tax Law, Bill amending and modifying the Law on Tax Procedure and Tax Administration, Bill amending and modifying the Law on Contributions for Mandatory Social Security Insurance, Bill amending and the Law on Salaries of Civil Servants and Employees, Bill on Reduction of Net Wages for Public Sector Employees and the Bill amending the Law on Property Restitution and Compensation.

At the proposal of the Committee on Finance, State Budget and Control of Public Spending, the National Assembly included the Proposal of the Decision on the Election of National Bank of Serbia Governor’s Council Member into the agenda for the Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013.

On the fourth day of the proceedings, 9 December, the National Assembly commenced a joint debate in principle and single debate on items 12, 13 and 14 on the agenda.
Prime Minister of the Republic of Serbia Ivica Dacic, Minister of Finance Lazar Krstic and Minister of Economy Sasa Radulovic addressed the MPs at the beginning of the discussion on the Republic of Serbia 2014 Budget Bill with its accompanying Proposal of the Decision granting consent to the Republic Pension and Disability Insurance Fund 2014 Financial Plan, Proposal of the Decision granting consent to the Republic Health Insurance Fund 2014 Financial Plan, Proposal of the Decision granting consent to the Fund for Social Insurance of Military Insured 2014 Financial Plan and the Proposal of the Decision granting consent to the National Employment Service 2014 Financial Plan, as well as on the Proposal of the Decision granting consent to the Decision amending and modifying the Republic Health Insurance Fund 2013 Financial Plan and the Proposal of the Decision granting consent to the Decision amending and modifying the National Employment Service 2013 Financial Plan.
For the remainder of the day the National Assembly conducted the joint debate in principle and single debate on items 12, 13 and 14 on the agenda.

On the fifth day of the proceedings, 10 December, before moving onto the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Riza Halimi, Emir Elfic, Sanja Jefic Brankovic, Olena Papuga, Olgica Batic, Neven Cveticanin, Kenan Hajdarevic, Zoran Ostojic, Ana Novkovic, Slobodan Samardzic, Bojana Djordjevic, Tamara Tripic and Ljubisa Stojmirovic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly conducted and, by the end of the day, concluded the joint debate in principle and single debate on the bills listed as items 12, 13 and 14 on the agenda for the sitting.

On the sixth day of the proceedings, 12 December, before moving onto the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Mirko Cikiriz, Judita Popovic, Zoran Ostojic, Marko Milutinovic and Aleksandar Senic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly went on to commence and, for the remainder of the day, conduct a debate in detail on item 12 on the agenda - Republic of Serbia 2014 Budget Bill.

On the seventh day of the proceedings, 13 December, the National Assembly continued and concluded the debate in detail on the Republic of Serbia 2014 Budget Bill.

As the National Assembly had concluded the debate in principle and in detail on items 12, 13 and 14 on the agenda for the sitting, the Chair, National Assembly Deputy Speaker Konstantin Arsenovic, reminded the MPs of the provision of article 87, paragraph 5, of the National Assembly Rules of Procedure according to which the National Assembly Speaker may set a Voting Day on a bill immediately after it has been discussed.
In accordance with the provision, National Assembly Speaker Dr Nebojsa Stefanovic, set Friday, 13 December 2013, at 5 pm, as Voting Day on items 12, 13 and 14 on the agenda for the Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013 viz. the Republic of Serbia 2014 Budget Bill with its accompanying Proposal of the Decision granting consent to the Republic Pension and Disability Insurance Fund 2014 Financial Plan, Proposal of the Decision granting consent to the Republic Health Insurance Fund 2014 Financial Plan, Proposal of the Decision granting consent to the Fund for Social Insurance of Military Insured 2014 Financial Plan and the Proposal of the Decision granting consent to the National Employment Service 2014 Financial Plan, Proposal of the Decision granting consent to the Decision amending and modifying the Republic Health Insurance Fund 2013 Financial Plan and the Proposal of the Decision granting consent to the Decision amending and modifying the National Employment Service 2013 Financial Plan.

Voting Day

On Voting Day, 13 December, by a majority of all the MPs’ votes, the National Assembly adopted the Republic of Serbia 2014 Budget Bill.
By a majority of votes, the National Assembly also adopted the Proposal of the Decision granting consent to the Republic Pension and Disability Insurance Fund 2014 Financial Plan, Proposal of the Decision granting consent to the Republic Health Insurance Fund 2014 Financial Plan, Proposal of the Decision granting consent to the Fund for Social Insurance of Military Insured 2014 Financial Plan and the Proposal of the Decision granting consent to the National Employment Service 2014 Financial Plan.
By a majority of MPs’ votes, the National Assembly also adopted the Proposal of the Decision granting consent to the Decision amending and modifying the Republic Health Insurance Fund 2013 Financial Plan and the Proposal of the Decision granting consent to the Decision amending and modifying the National Employment Service 2013 Financial Plan.

On the eighth day of the proceedings, 16 December, the National Assembly conducted and concluded a single debate on item 15 on the agenda – the Proposal of the Resolution on the Role of the National Assembly and Principles in the Negotiations on the Accession of the Republic of Serbia to the European Union. On the behalf of the submitters, the Resolution Proposal was elaborated by MP Natasa Vuckovic.

The National Assembly went on to complete a joint single debate on items 16 and 17 on the agenda – the Proposal of Authentic Interpretation of Provision of Article 2, Line Second of the Law on the Anti-Corruption Agency, submitted by the Committee on Constitutional and Legislative Issues of the National Assembly, and the Ruling on the Proposal to Adopt an Authentic Interpretation of Provision of Article 7, Paragraph 1 of the Law on the Anti-Corruption Agency, submitted by MP Zoran Babic.

The National Assembly conducted and concluded a joint single debate on items 18, 19 and 20 on the agenda – the Proposal of the Decision amending the Decision on the Election of Member and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Socialist Party of Serbia Parliamentary Group, Proposal of the Decision modifying the Decision on the Election of Member and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Democratic Party Parliamentary Group and the Proposal of the Decision amending the Decision on the Appointment of Heads of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, submitted by National Assembly Speaker Dr Nebojsa Stefanovic.

The National Assembly completed a single debate on item 21 on the agenda - the Proposal of the Decision on the Election of National Bank of Serbia Governor’s Council member, and a single debate on item 22 on the agenda – the Proposal of the Decision on the termination of office of public prosecutors at Basic Public Prosecutor’s Offices, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government proposing that it be discussed by urgent procedure.

As the National Assembly had concluded the debate on items 15, 16, 17, 18, 19, 20 and 21 on the agenda for the sitting, National Assembly Speaker Dr Nebojsa Stefanovic, set Monday, 16 December 2013, at 6.14 pm, as Voting Day on all the items on the agenda for the Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013 except for items 1 through 14 which the National Assembly had already voted on.

Voting Day

On Voting Day, 16 December, the National Assembly adopted the Proposal of the Resolution on the Role of the National Assembly and Principles in the Negotiations on the Accession of the Republic of Serbia to the European Union, by 158 MPs’ votes.

By a majority of all the MPs’ votes, the National Assembly adopted the Proposal of Authentic Interpretation of Provision of Article 2, Line Second of the Law on the Anti-Corruption Agency,

By a majority of votes, the National Assembly also adopted the Proposal of the Decision amending the Decision on the Election of Member and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, Proposal of the Decision modifying the Decision on the Election of Member and Deputy Members of the Committees of the National Assembly of the Republic of Serbia and the Proposal of the Decision amending the Decision on the Appointment of Heads of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions.

By a majority of MPs’ votes, the National Assembly adopted the Proposal of the Decision on the Election of National Bank of Serbia Governor’s Council member and the Proposal of the Decision on the termination of office of public prosecutors at Basic Public Prosecutor’s Offices.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the Sixth Sitting of the Second Regular Session and decided that none of the provisions of the Rules of Procedure had been violated.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, National Assembly Speaker Dr Nebojsa Stefanovic concluded the Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013.
