Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2010

The Speaker of the National Assembly of the Republic of Serbia, Prof. Dr Slavica Djukic-Dejanovic, convened the Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2010, for Tuesday, 30 November 2010, starting at 11 a.



The Speaker of the National Assembly of the Republic of Serbia, Prof. Dr Slavica Djukic-Dejanovic, convened the Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2010, for Tuesday, 30 November 2010, starting at 11 a.m.

The National Assembly set the following agenda:

1. The Bill amending and modifying the Tobacco Law, submitted by the Government;

2. The Bill amending and modifying the Law on Games of Chance, submitted by the Government;

3. The Bill amending and modifying the Law on State Administration, submitted by the Government;

4. The Bill amending and modifying the Law on Military, Labour and Material Duty, submitted by the Government;

5. The Proposal of the Decision on the Abolishment of Mandatory Military Service, submitted by the Government;

6. The Bill on the Confirmation of the Protocol on Prohibitions or Restrictions on the Use of Mines, Booby-Traps and Other Devices as amended on 3 May 1996 (Protocol II as amended on 3 May 1996) annexed to the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons which may be deemed to be Excessively Injurious of to have Indiscriminate Effects, submitted by the Government;

7. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of Montenegro on the exchange of resources and documentation, submitted by the Government;

8. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of Montenegro on cooperation in the protection against natural and other disasters, submitted by the Government;

9. The Bill on the Confirmation of the Scientific and Technological Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Italy, submitted by the Government;

10. The Bill on the Confirmation of the Scientific and Technological Cooperation Agreement between the Government of the Republic of Serbia and the Government of the United States of America, submitted by the Government;

11. The Bill on the Confirmation of the Scientific and Technological Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Austria, submitted by the Government;

12. The Bill on the Confirmation of the Youth Mobility Agreement between the Republic of Serbia and the Republic of France, submitted by the Government;

13. The Bill on the Confirmation of the Agreement between the Republic of Serbia and the Kingdom of Spain on the employment of family members of the diplomatic, consular, administrative and technical staff of diplomatic and consular representative offices, submitted by the Government;

14. The Bill on the Confirmation of the Agreement between the Republic of Serbia and the Kingdom of Belgium on the performance of lucrative activities by certain family members of the staff of diplomatic and consular representative offices, submitted by the Government;

15. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Oriental Republic of Uruguay on visa abolition for bearers of diplomatic and official passports, submitted by the Government;

16. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Kazakhstan on visa abolition for their citizens, submitted by the Government;

17. The Bill on the Confirmation of the Memorandum of Understanding between the Government of the Republic of Serbia and the Government of Holland on the lucrative activities of supported family members of diplomatic and other staff of diplomatic and consular representative offices, submitted by the Government;

18. The Bill amending the Law on the Ratification of the European Convention for the Protection of Human Rights and Fundamental Freedoms, as amended by Protocol 11, Protocol to the Convention for the Protection of Human Rights and Fundamental Freedoms, Protocol 4 to the Convention for the Protection of Human Rights and Fundamental Freedoms securing certain rights and freedoms other than those already included in the Convention and the first Protocol thereto, Protocol 6 to the Convention for the Protection of Human Rights and Fundamental Freedoms concerning the abolition of the Death Penalty, Protocol 7 to the Convention for the Protection of Human Rights and Fundamental Freedoms, Protocol 12 to the Convention for the Protection of Human Rights and Fundamental Freedoms and Protocol 13 to the Convention for the Protection of Human Rights and Fundamental Freedoms concerning the abolition of the death penalty in all circumstances, submitted by the Government;

19. The Bill amending the Law on the Confirmation of the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, submitted by the Government;

20. The Bill amending the Law on the Confirmation of the European Convention on Extradition with additional protocols, submitted by the Government;

21. The Bill on the Confirmation of the Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine: Convention on Human Rights and Biomedicine, submitted by the Government;

22. The Bill on the Confirmation of the Cooperation Agreement between the Republic of Serbia and the State of Kuwait in the sphere of healthcare, submitted by the Government;

23. The Bill on the Confirmation of the Social Security Agreement between the Republic of Serbia and the Republic of Cyprus, submitted by the Government;

24. The Bill on the Confirmation of the Social Security Agreement between the Republic of Serbia and the Kingdom of Belgium, submitted by the Government;

25. The Bill on the Confirmation of the Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Argentina in the sphere of veterinary medicine, submitted by the Government;

26. The Bill on the Confirmation of the Memorandum of Understanding between the Government of the Republic of Serbia and the Government of the Arab Republic of Egypt on veterinary cooperation, submitted by the Government;

27. The Bill on the Confirmation of the Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Tunisia in the sphere of veterinary medicine, submitted by the Government;

28. The Bill on the Confirmation of the Scientific and Technological Cooperation Agreement in the sphere of agriculture between the Government of the Republic of Serbia and the Government of the Republic of Tunisia, submitted by the Government;

29. The Bill on the Confirmation of the International Road Transport Agreement between the Government of the Republic of Serbia and the Government of the Kingdom of Belgium, submitted by the Government;

30. The Bill on the Confirmation of the Protocol of 1992 to amend the International Convention on Civil Liability for Oil Pollution Damage of 29 November 1969, submitted by the Government;

31. The Bill on the Confirmation of the Protocol of 1992 to amend the International Convention on the establishment of an International Fund for Compensation for Oil Pollution Damage of 18 December 1971, submitted by the Government;

32. The Bill on the Confirmation of Decision No 1/2008 of the ECAA Joint Committee of 10 December 2008 replacing Annex I to the Multilateral Agreement between the European Community and its Member States, the Republic of Albania, Bosnia and Herzegovina, Republic of Bulgaria, Republic of Croatia, Former Yugoslav Republic of Macedonia, Republic of Iceland, Republic of Montenegro, Kingdom of Norway, Romania, Republic of Serbia and United Nations Interim Administration Mission in Kosovo (in line with UN Security Council Resolution 1244 of 10 June 1999) on the establishment of a European Common Aviation Area, submitted by the Government;

33. The Proposal of the Decision amending the Decision on the establishment of the composition of standing delegations of the National Assembly of the Republic of Serbia to international parliamentary institutions, submitted by the Speaker of the National Assembly, Prof. Dr Slavica Djukic-Dejanovic (No. 02-3122/10 of 26 November 2010).

By a majority of votes, the National Assembly decided to conduct a joint discussion in principle on items 1 and 2 on the agenda, a joint discussion in principle and unified discussion on items 4 through 7 on the agenda and joint unified discussion on items 8 through 32 on the agenda for the session.

For the remainder of the day the National Assembly conducted and concluded the joint discussion in principle on the Bills amending and modifying the Tobacco Law and the Law on Games of Chance, elaborated by Bozidar Djelic, Deputy Prime Minister and Minister of Science and Technological Development.

On the second day of work, 1 December, the National Assembly completed a debate in principle on the Bill amending and modifying the Law on State Administration.

Before moving on to the agenda, National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic, informed the deputies that 1 December is the World AIDS Day, adding that people with HIV live among us and we as a society owe them support.

In addition, at the proposal of the Administrative Committee, the National Assembly noted the existence of sufficient grounds to verify the term of office of deputy Bojan Djuric, elected from the Liberal Democratic Party – Cedomir Jovanovic electoral list.


On the third day of work, 2 December, the National Assembly continued the session with a joint debate in principle and unified debate on the Bill amending and modifying the Law on Military, Labour and Material Duty, Proposal of the Decision on the Abolishment of Mandatory Military Service, Bill on the Confirmation of the Protocol on Prohibitions or Restrictions on the Use of Mines, Booby-Traps and Other Devices as amended on 3 May 1996 (Protocol II as amended on 3 May 1996) annexed to the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons which may be deemed to be Excessively Injurious of to have Indiscriminate Effects and the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of Montenegro on the exchange of resources and documentation, elaborated by Minister of Defence Dragan Sutanovac.

Before moving on to the agenda, deputies Konstantin Arsenovic, Arsen Djuric, Cedomir Jovanovic, Srdjan Spasojevic, Zoran Babic and Dragan Todorovic requested information and explanations in line with article 286 of the National Assembly Rules of Procedure

The Chair, National Assembly Deputy Speaker Gordana Comic informed the deputies that part of the sitting was being observed from the gallery of the Great Hall of the National Assembly House by a group of students from Ada.

After recess, the Chair, Deputy Speaker Gordana Comic again informed the deputies that part of the National Assembly sitting was being observed from the gallery of the Great Hall by a group of elementary and high-school students of the Stevan Hristic Music School from Krusevac.

By the end of the day the National Assembly had completed the joint debate in principle and unified debate on the Bills.

At the beginning of the fourth day of the session, 7 December, the heads i.e. authorised representatives of the Deputy Groups Dragan Todorovic, Dragan Sormaz, Jovan Damjanovic, Zoran Sami, Kenan Hajdarevic and Aleksandar Jugovic requested information and explanations in line with article 286 of the National Assembly Rules of Procedure.

The National Assembly conducted and concluded a joint unified discussion on the 25 Bills on the confirmation of international agreements, conventions, protocols and other documents.

The National Assembly completed a unified discussion on the Proposal of the Decision amending the Decision on the establishment of the composition of standing delegations of the National Assembly of the Republic of Serbia to international parliamentary institutions.


On the fifth day of work, 8 December, the National Assembly completed a debate on the particulars on the Bills amending and modifying the Tobacco Law and the Law on Games of Chance.

National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic informed the deputies that part of the sitting was being viewed from the gallery of the Great Hall by the members of the Croatian Inter-Parliamentary Friendship Group with Serbia, in official visit to the National Assembly and greeted them on the behalf of the deputies.

On the sixth day of work, 9 December, the National Assembly continued the session with a debate on the particulars on the Bill amending and modifying the Law on State Administration.

Before moving on to the agenda, the Chair, National Assembly Deputy Speaker Gordana Comic reminded the deputies that on this day in 1990 the Republic of Serbia held its first multi-party elections, adding that 20 years later we are witnesses of the fact that the multi-party system has taken root in Serbia. She added that parliamentarism in Serbia already has all the attributes of democratic parliamentarism and expressed belief that the deputies would contribute to its further improvement.

Before commencing proceedings, deputies Balint Pasztor, Zlata Djeric, Nebojsa Randjelovic, Miroslav Petkovic, Jorgovanka Tabakovic and Dragan Todorovic requested information and explanations in line with article 286 of the Rules of Procedure.

In the morning part of the proceedings, the National Assembly Deputy Speaker informed the deputies that part of the sitting was being observed from the gallery of the Great Hall of the National Assembly House by a group of students of the Belgrade Faculty of Security whom she greeted on the behalf of the deputies and herself.

In the course of the debate on the particulars on item 3 on the agenda, the Chair twice reprimanded deputy Milan Avramovic for disturbing the order at the National Assembly sitting.

By the end of the morning part of the sitting, the National Assembly had completed the debate on the particulars on the Bill amending and modifying the Law on State Administration.

After recess, the National Assembly completed a debate on the particulars on the Bill amending and modifying the Law on Military, Labour and Material Duty.

Since the National Assembly had completed the discussion in principle and on the particulars on all the items on the agenda, National Assembly Deputy Speaker Gordana Comic informed the deputies that they would be informed about the Voting Day on the items on the agenda for the Sixth Sitting of the Second Regular Session of the National Assembly of in 2010, in a timely manner, in line with the provisions of the Rules of Procedure.

On Voting Day, the National Assembly also ruled on the violation of article 107 of the Rules of Procedure that deputy Ivan Jovanovic complained of in the course of the sitting and decided that the abovementioned article of the National Assembly Rules of Procedure had not been violated.

As the National Assembly had completed the discussion on all the items on the agenda and ruled on them, National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic concluded the Sixth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2010.
