Seventh Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2016

The Speaker of the National Assembly of the Republic of Serbia Maja Gojkovic convened the Seventh Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2016 for Thursday, 22 December, starting at 3 pm.


Before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Miroslav Aleksic, Nada Lazic, Bosko Obradovic, Marjana Maras, MA Aleksandra Jerkov, Marijan Risticevic, Cedomir Jovanovic, Nemanja Sarovic, Sasa Radulovic and Miroslav Milojevic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly adopted the following agenda:

  1. Bill amending and modifying the Law on Salary System of Public Sector Employees, submitted by the Government;
  2. Bill amending the Law on Public Media Services, submitted by the Government;
  3. Bill amending the Law on Temporary Regulation of Payment of Fees for the Public Media Service, submitted by the Government;
  4. Bill amending and modifying the Law on Organisation of Courts, submitted by MP Dr Aleksandar Martinovic;
  5. Bill amending and modifying the Law on Capital Market, submitted by the Government;
  6. Bill amending and modifying the Law on Takeover of Joint Stock Companies, submitted by the Government;
  7. Bill amending and modifying the Law on Public Property, submitted by the Government;
  8. Bill amending and modifying the Excise Tax Law, submitted by the Government;
  9. Bill amending and modifying the Value Added Tax Law, submitted by the Government;
  10. Bill amending and modifying the Law on Tax Procedure and Tax Administration, submitted by the Government;
  11. Bill on Assumption of Obligations of “HIP – Petrohemija”, Pancevo, JSC for production of petrochemical products, raw materials and chemicals toward the Petroleum Industry of Serbia a.d. Novi Sad and Transformation of Said Obligations into the Public Debt of the Republic of Serbia, submitted by the Government;
  12. Bill amending and modifying the Customs Law, submitted by the Government;
  13. Bill on Real Estate Appraisers, submitted by the Government;
  14. Bill amending and modifying the Law on the Settlement of Public Debt of the Federal Republic of Yugoslavia arising from Citizens’ Foreign Exchange Savings, submitted by the Government;
  15. Bill on the Settlement of Public Debt of the Republic of Serbia arising from Unpaid Citizens’ Foreign Exchange Savings Deposited in Banks with Headquarters on the Territory of the Republic of Serbia and Branch Offices on the Territory of Former SFRY Republics, submitted by the Government;
  16. Bill on the Confirmation of the Preferential Buyer Credit Loan Agreement on Construction of Highway E-763 (section Surcin-Obrenovac) Project between the Government of the Republic of Serbia, represented by the Ministry of Finance, as Borrower and the Chinese Export-Import Bank as Creditor, submitted by the Government;
  17. Bill on the Confirmation of the Loan Agreement (Additional Funding for Corridor 10 Highway Project) between the Republic of Serbia and the International Bank for Reconstruction and Development, submitted by the Government;
  18. Bill on the Confirmation of the Loan Agreement (Second Programmatic State Owned Enterprises Reform Development Loan) between the Republic of Serbia and the International Bank for Reconstruction and Development, submitted by the Government;
  19. Proposal of an authentic interpretation of the provisions of Article 1, Article 5, paragraph 1 and Article 53, paragraphs 1 and 2 of the Expropriation Law (“RS Official Gazette”, no. 53/95, 23/01-SUS, 20/09 and 55/13-US), submitted by the Committee on Constitutional and Legislative Issues;
  20. Proposal of an authentic interpretation of the provision of Article 48 of the Law on Enforcement and Security (“RS Official Gazette”, no. 106/15), submitted by the Committee on Constitutional and Legislative Issues;
  21. Proposal of the Decision on the termination of office of public prosecutor at the Basic Public Prosecutor’s Office in Trstenik, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government;
  22. Proposal of the Decision on the election of member of the Council of the Governor of the National Bank of Serbia, submitted by the Committee on Finance, State Budget and Control of Public Spending;
  23. Proposal of the Decision on the election of two members of the Republic Commission for Protection of Rights in Public Procurement Procedures, submitted by the Committee on Finance, State Budget and Control of Public Spending;
  24. Election of member of the Council of the Commission for Protection of Competition, submitted by the Committee on the Economy, Regional Development, Trade, Tourism and Energy;
  25. Election of members of the Council of the Regulatory Authority for Electronic Media from the candidate lists submitted by authorised nominators:
    - associations dealing with freedom of expression and the protection of children and
    - universities accredited in the Republic of Serbia;
  26. Election of Anti-Corruption Agency Board member, submitted by the Committee on Administrative, Budgetary, Mandate and Immunity Issues;
  27. Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Serbian Progressive Party Parliamentary Group.
The National Assembly accepted the proposal of MP Dr Aleksandar Martinovic to complete a joint debate in principle and single debate on all the items on the agenda.

The National Assembly proceeded to commence the joint debate in principle and single debate on all the items on the agenda.

The bills, decision proposals and other documents were presented to the MPs by the representatives of the submitter: Minister of Public Administration and Local Self-Government Ana Brnabic, Minister of Mining and Energy Aleksandar Antic, Minister of Agriculture and Environmental Protection Branislav Nedimovic, Minister of Culture and the Media Vladan Vukosavljevic, Chairperson of the Committee on Finance, State Budget and Control of Public Spending Dr Aleksandra Tomic and the Chairperson of the Committee on the Economy, Regional Development, Trade, Tourism and Energy Snezana B. Petrovic.

On the second day of the proceedings, 23 December, the National Assembly conducted the joint debate in principle and single debate on items 1 through 27 on the agenda.

Based on the report of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly went on to note the termination of the term of office of MP Ivica Toncev, before the expiry of the term he was elected for, on the day he tendered his resignation.

For the remainder of the workday the National Assembly conducted the joint debate in principle and single debate on all the items on the agenda.

On the third day of the proceedings, 26 December, the National Assembly completed the joint debate in principle and single debate on items 1 through 27 on the agenda.

As the National Assembly had completed the joint debate in principle and single debate on all the items on the agenda of the Seventh Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2016, the Chair, National Assembly Speaker Maja Gojkovic set Tuesday, 27 December, as Voting Day on items 16 to 27 i.e. the items on which the debate was concluded, starting at 10 am.

Voting Day on items 16 to 27 on the agenda

On Voting Day on items 16 to 27 on the agenda, 27 December, the National Assembly passed the Bill on the Confirmation of the Preferential Buyer Credit Loan Agreement on Construction of Highway E-763 (section Surcin-Obrenovac) Project between the Government of the Republic of Serbia, represented by the Ministry of Finance, as Borrower and the Chinese Export-Import Bank as Creditor, submitted by the Government. By majority vote, the National Assembly also passed the Bill on the Confirmation of the Loan Agreement (Additional Funding for Corridor 10 Highway Project) between the Republic of Serbia and the International Bank for Reconstruction and Development, as well as the Bill on the Confirmation of the Loan Agreement (Second Programmatic State Owned Enterprises Reform Development Loan) between the Republic of Serbia and the International Bank for Reconstruction and Development, submitted by the Government.

The National Assembly also adopted the Proposal of an authentic interpretation of the provisions of Article 1, Article 5, paragraph 1 and Article 53, paragraphs 1 and 2 of the Expropriation Law, and the Proposal of an authentic interpretation of the provision of Article 48 of the Law on Enforcement and Security, submitted by the Committee on Constitutional and Legislative Issues.

The MPs adopted the Proposal of the Decision on the termination of office of public prosecutor at the Basic Public Prosecutor’s Office in Trstenik, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government.

By majority vote, the National Assembly also adopted the Proposal of the Decision on the election of member of the Council of the Governor of the National Bank of Serbia, submitted by the Committee on Finance, State Budget and Control of Public Spending.

The MPs also adopted the Proposal of the Decision on the election of two members of the Republic Commission for Protection of Rights in Public Procurement Procedures, submitted by the Committee on Finance, State Budget and Control of Public Spending.

On Voting Day, by majority vote, the National Assembly elected Cedomir Radojcic member of the Council of the Commission for Protection of Competition.

The MPs elected as member of the Council of the Regulatory Authority for Electronic Media from the candidate list submitted by authorised nominator: associations dealing with freedom of expression and the protection of children, Radoje Kujovic, and as member of the Council of the Regulatory Authority for Electronic Media from the candidate list submitted by authorised nominator: universities accredited in the Republic of Serbia, Goran Petrovic.

By majority vote, the National Assembly elected Danica Marinkovic member of the Anti-Corruption Agency Board from the list of candidates submitted by the Committee on Administrative, Budgetary, Mandate and Immunity Issues.

The National Assembly also adopted the Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Serbian Progressive Party Parliamentary Group.

Having voted on items 16 to 27 on the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Prof. Dr Vojislav Seselj, Prof. Dr Marko Atlagic, Miloje Miletic, Srdjan Nogo, Dr Predrag Jelenkovic, Radoslav Milojicic and Sasa Radulovic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

On the fourth day of the proceedings, 27 December, the National Assembly completed a debate in detail on items 1 to 15 on the agenda.

As the National Assembly completed the debate on all the items on the agenda of the Seventh Sitting of the Second Regular Session, the Chair, National Assembly Deputy Speaker Veroljub Arsic called a recess until noon, on Wednesday, 28 December 2016.

On the fifth day of the proceedings, 28 December, based on the Decision of the Republic Electoral Commission and the Report of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the verification of the term of office of MP Ivana Dinic, elected from the Electoral List IVICA DACIC – “Socialist Party of Serbia (SPS), United Serbia (JS) – Dragan Markovic Palma”.

After the newly-elected MP had taken the oath of office, National Assembly Speaker Maja Gojkovic congratulated her and wished her success.

As the National Assembly had completed the debate, in principle and in detail, on items 1 to 15 on the agenda of the Seventh Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2016, the Chair, National Assembly Speaker Maja Gojkovic set Wednesday, 28 December, as Voting Day on items 1 to 15, starting at 12.10 pm.

On Voting day, by majority vote, the National Assembly passed the Bill amending and modifying the Law on Salary System of Public Sector Employees, Bill amending the Law on Public Media Services, Bill amending the Law on Temporary Regulation of Payment of Fees for the Public Media Service, Bill amending and modifying the Law on Organisation of Courts, Bill amending and modifying the Law on Capital Market, Bill amending and modifying the Law on Takeover of Joint Stock Companies, Bill amending and modifying the Law on Public Property, Bill amending and modifying the Excise Tax Law, Bill amending and modifying the Value Added Tax Law, Bill amending and modifying the Law on Tax Procedure and Tax Administration, Bill on Assumption of Obligations of “HIP – Petrohemija”, Pancevo, JSC for production of petrochemical products, raw materials and chemicals toward the Petroleum Industry of Serbia a.d. Novi Sad and Transformation of Said Obligations into the Public Debt of the Republic of Serbia, Bill amending and modifying the Customs Law, Bill on Real Estate Appraisers, Bill amending and modifying the Law on the Settlement of Public Debt of the Federal Republic of Yugoslavia arising from Citizens’ Foreign Exchange Savings, and the Bill on the Settlement of Public Debt of the Republic of Serbia arising from Unpaid Citizens’ Foreign Exchange Savings Deposited in Banks with Headquarters on the Territory of the Republic of Serbia and Branch Offices on the Territory of Former SFRY Republics.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the sitting and decided that none of the provisions of the Rules of Procedure had been violated.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, National Assembly Speaker Maja Gojkovic concluded the Seventh Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2016.
