Second Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2015

The Speaker of the National Assembly of the Republic of Serbia Maja Gojkovic convened the Second Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2015 for Friday, 9 October 2015, starting at 10 am.


The National Assembly adopted the following agenda:

1. Bill amending and modifying the Railway Law, submitted by the Government;
2. Bill amending and modifying the Law on Railway Safety and Interoperability, submitted by the Government;
3. Bill on the Confirmation of the International Combined Transport Agreement between the Government of the Republic of Serbia and the Government of the Slovak Republic, submitted by the Government;
4. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of Hungary on Road Transport of Passengers and Goods, submitted by the Government;
5. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Tunisia on Road Transport of Passengers and Goods, submitted by the Government;
6. Bill amending and modifying the Law on Safety and Health in the Workplace, submitted by the Government;
7. Bill on Requirements for Assigning Employees to Temporarily Work Abroad and their Protection, submitted by the Government;
8. Bill on the Confirmation of the Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in respect of Parental Responsibility and Measures for the Protection of Children, submitted by the Government;
9. Proposal of the Decision on the Termination of Office of President of Cacak Commercial Court, submitted by the High Judicial Council;
10. Proposal of the Decision on the election of judges to judicial office for the first time, submitted by the High Judicial Council;
11. Collective Candidate List for the election of the first half of National Education Council members to a six-year term, submitted by the Committee on Education, Science, Technological Development and the Information Society;
12. Proposal of the Decision on the Discharge of a member of the National Council for Higher Education, submitted by the Committee on Education, Science, Technological Development and the Information Society;
13. Proposal for an authentic interpretation of the provisions of articles 27, 28, 40 and 71 of the Law on Corporate Profit Tax (Official Gazette of the Republic of Serbia, No. 25/01, 80/02, 80/02- state law, 43/03, 84/04 and 18/10), and Article 41, paragraph 3, of the Law on Tax Procedure and Tax Administration(Official Gazette of the Republic of Serbia, No. 80/02, 84/02-amendment, 23/03- amendment, 70/03, 55/04, 61/05, 85/05-state law, 62/06-state law and 61/07), submitted by the Committee on Constitutional and Legislative Issues.

The National Assembly accepted the proposal of MP Zoran Babic to complete a joint debate in principle and single debate on items 1, 2, 3, 4 and 5 on the agenda, joint debate in principle and single debate on items 6, 7 and 8 on the agenda, as well as a joint single debate on items 11 and 12 on the agenda for the sitting.

The National Assembly then commenced the joint debate in principle and single debate on the Bill amending and modifying the Railway Law, Bill amending and modifying the Law on Railway Safety and Interoperability, Bill on the Confirmation of the International Combined Transport Agreement between the Government of the Republic of Serbia and the Government of the Slovak Republic, Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of Hungary on Road Transport of Passengers and Goods, and the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Tunisia on Road Transport of Passengers and Goods.

The bills were elaborated by Deputy Prime Minister and Minister of Construction, Transport and Infrastructure Prof. Dr Zorana Mihajlovic as representative of the submitter.

By the end of the day, the National Assembly had completed the joint debate in principle and single debate on items 1, 2, 3, 4 and 5 on the agenda.

On the second day of the proceedings, 13 October, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Aleksandar Cotric, Dr Blagoje Bradic, Nedjo Jovanovic, Olena Papuga, Borislav Stefanovic and Prof. Dr Marko Atlagic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

At the proposal of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the termination of the term of office of MP Snezana Malovic, before the expiry of the term she was elected for, on the day she tendered her resignation.

The National Assembly then proceeded to complete a joint debate in principle and single debate on the Bill amending and modifying the Law on Safety and Health in the Workplace, Bill on Requirements for Assigning Employees to Temporarily Work Abroad and their Protection, and the Bill on the Confirmation of the Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in respect of Parental Responsibility and Measures for the Protection of Children.

Minister of Labour, Employment, Veteran and Social Affairs Aleksandar Vulin provided the rationale for the bills as representative of the submitter.

On the third day of the proceedings, 14 October, the National Assembly conducted and concluded the joint single debate on items 9 and 10 on the agenda – the Proposal of the Decision on the Termination of Office of President of Cacak Commercial Court and the Proposal of the Decision on the election of judges to judicial office for the first time, elaborated on the behalf of the submitter by Branka Bancevic, member of the High Judicial Council.

The National Assembly also commenced and concluded the joint single debate on items 11 and 12 on the agenda – the Collective Candidate List for the election of the first half of National Education Council members to a six-year term and the Proposal of the Decision on the Discharge of a member of the National Council for Higher Education, submitted by the Committee on Education, Science, Technological Development and the Information Society, and elaborated by Member of Parliament MA Aleksandra Jerkov as representative of the submitter.

By the end of the day the National Assembly had also completed a debate on the Proposal for an authentic interpretation of the provisions of articles 27, 28, 40 and 71 of the Law on Corporate Profit Tax (Official Gazette of the Republic of Serbia, No. 25/01, 80/02, 80/02- state law, 43/03, 84/04 and 18/10), and Article 41, paragraph 3, of the Law on Tax Procedure and Tax Administration (Official Gazette of the Republic of Serbia, No. 80/02, 84/02-amendment, 23/03- amendment, 70/03, 55/04, 61/05, 85/05-state law, 62/06-state law and 61/07), submitted by the Committee on Constitutional and Legislative Issues.

On the fourth day of the proceedings, 15 October, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Dragan Jovanovic, Muamer Bacevac, Aleksandar Senic, Riza Halimi, Aleksandar Jovicic and Borislav Stefanovic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The MPs then proceeded to commence a debate in detail on the Bill amending and modifying the Railway Law.

The National Assembly conducted and concluded the debate in detail on the Bill amending and modifying the Railway Law, and by the end of the day, also completed a debate in detail on the Bill amending and modifying the Law on Railway Safety and Interoperability.

On the fifth day of the proceedings, 16 October, the National Assembly conducted and concluded a debate on the amendments submitted to items 6 and 7 on the agenda.

In the course of the proceedings of the Fourth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2015, the Chair, National Assembly Deputy Speaker MA Igor Becic, set Tuesday, 3 November 2015, as Voting Day on all the items on the agenda for the Second Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2015, as the National Assembly completed the debate, in principle and in detail, on all the items on the agenda, starting at 5 pm.

Voting Day

On Voting Day, 3 November, by majority vote, the National Assembly passed the following:

1.Bill amending and modifying the Railway Law, submitted by the Government;

2.Bill amending and modifying the Law on Railway Safety and Interoperability, submitted by the Government;

3.Bill on the Confirmation of the International Combined Transport Agreement between the Government of the Republic of Serbia and the Government of the Slovak Republic, submitted by the Government;

4.Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of Hungary on Road Transport of Passengers and Goods, submitted by the Government;

5.Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Tunisia on Road Transport of Passengers and Goods, submitted by the Government;

6.Bill amending and modifying the Law on Safety and Health in the Workplace, submitted by the Government;

7.Bill on Requirements for Assigning Employees to Temporarily Work Abroad and their Protection, submitted by the Government;

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the sitting and decided that none of the provisions of the Rules of Procedure had been violated.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, the Chair, National Assembly Speaker Maja Gojkovic concluded the Second Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2015.
