First Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2010

The Speaker of the National Assembly of the Republic of Serbia, Prof. Dr Slavica Djukic-Dejanovic, convened the First Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2010, for Tuesday, 2 March 2010, starting at 10 a.



The Speaker of the National Assembly of the Republic of Serbia, Prof. Dr Slavica Djukic-Dejanovic, convened the First Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2010, for Tuesday, 2 March 2010, starting at 10 a.m.

Before moving on to the agenda, deputies Cedomir Jovanovic, Slobodan Samardzic, Velimir Ilic, Jorgovanka Tabakovic, Jovan Damjanovic and Dragan Todorovic exercised their right under article 235 of the Rules of Procedure and requested information and/or explanations from governmental institutions.

The National Assembly adopted the following agenda:

1. The Customs Bill, submitted by the Government of the Republic of Serbia;

2. The Bill amending and modifying the Corporate Income Tax Law, submitted by the Government of the Republic of Serbia;

3. The Bill amending and modifying the Personal Income Tax Law, submitted by the Government of the Republic of Serbia;

4. The Bill on the indebtedness of the Republic of Serbia at Erste GCIB Finance I.B.V. Amsterdam, with Erste Bank a.d. Novi Sad as agent, Marfin Bank a.d. Belgrade and Vojvodjanska Banka a.d. Novi Sad, submitted by the Government of the Republic of Serbia;

5. The Bill granting guarantee by the Republic of Serbia in favour of Banca Intesa a.d. Belgrade under the debt of Public Enterprise Srbijagas Novi Sad, submitted by the Government of the Republic of Serbia;

6. The Bill on Pre-School Upbringing and Education, submitted by the Government of the Republic of Serbia;

7. The Bill on Pupil and Student Standard, submitted by the Government of the Republic of Serbia;

8. The Bill on Wild Game and Hunting, submitted by the Government of the Republic of Serbia;

9. The Bill amending and modifying the Law on Scientific and Research Activities, submitted by the Government of the Republic of Serbia;

10. The Bill amending and modifying the Law on Innovative Activities, submitted by the Government of the Republic of Serbia;

11. The Bill on the Serbian Academy of Sciences and Arts (SANU), submitted by the Government of the Republic of Serbia;

12. The Bill on Geographical Indications, submitted by the Government of the Republic of Serbia;

13. The Amnesty Bill, submitted by the Government of the Republic of Serbia;

14. The Bill amending and modifying the Law on State Land Survey and Cadastre, submitted by the Government of the Republic of Serbia;

15. The Bill amending and modifying the Law on International Road Transport, submitted by the Government of the Republic of Serbia;

16. The Bill on the Confirmation of the Patent Law Treaty, submitted by the Government of the Republic of Serbia;

17. The Bill on the Confirmation of the Nice Agreement Concerning the International Classification of Goods and Services for the Purpose of the Registration of Marks of 15 June 1957, as revised in Stockholm on 14 July 1967 and Geneva on 13 May 1977 and as amended on 28 September 1979, submitted by the Government of the Republic of Serbia;

18. The Bill on the Confirmation of the Police Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of France, submitted by the Government of the Republic of Serbia;

19. The Bill on the Confirmation of the Police Cooperation Agreement between the Government of the Republic of Serbia and the Swiss Confederation in the fight against crime, submitted by the Government of the Republic of Serbia;

20. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the State of Israel on cooperation in the fight against illicit traffic in and abuse of narcotics and psychotropic substances, terrorism and other grave criminal offenses, submitted by the Government of the Republic of Serbia;

21. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Swiss Confederation on readmission of persons residing illegally with Implementation Protocol to the Agreement, submitted by the Government of the Republic of Serbia;

22. The Bill on the Confirmation of the Police Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Croatia, ,submitted by the Government of the Republic of Serbia;

23. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Croatia on extradition and acceptance of persons of illegal entry or residence, with Implementation Protocol to the Agreement, submitted by the Government of the Republic of Serbia;

24. The Bill on the Confirmation of the Agreement between the Republic of Serbia and the Kingdom of Norway on readmission of persons residing illegally, submitted by the Government of the Republic of Serbia;

25. The Bill on the Confirmation of the Protocol between the Government of the Republic of Serbia and the Government of the Republic of Italy on the Implementation of the Agreement between the Republic of Serbia and the European Community on readmission of persons residing illegally, submitted by the Government of the Republic of Serbia;

26. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Kingdom of Spain on reciprocal recognition and exchange of national driver’s licenses, submitted by the Government of the Republic of Serbia;

27. The Bill on the Confirmation of the Agreement between Serbia and Montenegro and Bosnia and Herzegovina on borderland transport, submitted by the Government of the Republic of Serbia;

28. The Bill on the Confirmation of the Agreement Determining Border Crossing Points between Serbia and Montenegro and Bosnia and Herzegovina, submitted by the Government of the Republic of Serbia;

29. The Bill on the Confirmation of the Guarantee Contract (Refinancing short-term loan, construction of an underground gas storage facility and maintenance of gas transmission and distribution networks) between the Republic of Serbia and the European Bank for Reconstruction and Development, submitted by the Government of the Republic of Serbia;

30. The Bill on the Confirmation of the Loan and Financing Agreement between KfW, Frankfurt an Main and the Republic of Serbia – Water supply and sewerage programme in medium-sized municipalities in Serbia I – Phase 2, submitted by the Government of the Republic of Serbia;

31. The Bill on the Confirmation of the International Convention for the Protection New Varieties of Plants, submitted by the Government of the Republic of Serbia;

32. The Bill on the Confirmation of the Agreement between Serbia and Montenegro and the United States of America on the status of the International School of Belgrade, submitted by the Government of the Republic of Serbia;

33. The Candidate List for the Election of a member of the Council of the Republic Broadcasting Agency, submitted by authorised submitters;

34. The Proposal of the Decision on the Election of Chairman and members of the Republic Commission for the Protection of Rights in Public Procurement Procedures, submitted by the Government of the Republic of Serbia;

35. The Proposal for the Election of Deputy Commissioner for Information of Public Importance and Personal Data Protection, submitted by the Commissioner for Information of Public Importance and Personal Data Protection;

36. The Request to relieve of duty a member of the Health Council of the Republic of Serbia, submitted by Prof. Dr Slobodan Jankovic;

37. The Proposal of the Decision determining the composition of the standing delegation of the National Assembly of the Republic of Serbia to the Francophone Parliamentary Assembly, submitted by the Speaker of the National Assembly of the Republic of Serbia;

38. The Proposal of the Decision amending the Decision on the election of members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Socialist Party of Serbia (SPS) - United Serbia (US) Deputy Group.

By a majority of votes, the National Assembly decided to conduct a joint discussion in principle on items 1, 2, 3, 4 and 5 on the agenda; joint discussion in principle and joint discussion on items 6, 7 and 32 on the agenda; joint discussion in principle and joint discussion on items 8 and 31 on the agenda; joint discussion in principle and joint discussion on items 9, 10, 11, 12, 16 and 17 on the agenda; joint discussion on items 18, 19, 20, 21, 22, 23, 24, 25, 26, 27 and 28 on the agenda; joint discussion on items 29 and 30 on the agenda; as well as a joint discussion on items 33, 34, 35, 36, 37 and 38 on the agenda.

In the morning part of the proceedings, the National Assembly commenced a joint discussion in principle on the Customs Bill, Bill amending and modifying the Corporate Income Tax Law, Bill amending and modifying the Personal Income Tax Law, Bill on the indebtedness of the Republic of Serbia at Erste GCIB Finance I.B.V. Amsterdam, with Erste Bank a.d. Novi Sad as agent, Marfin Bank a.d. Belgrade and Vojvodjanska Banka a.d. Novi Sad and the Bill granting guarantee by the Republic of Serbia in favour of Banca Intesa a.d. Belgrade under the debt of Public Enterprise Srbijagas Novi Sad. The Bills were outlined for the deputies by Minister of Finance Diana Dragutinovic, representative of the submitters.

At the proposal of the Administrative Committee, the National Assembly went on to note the termination of office before the expiration of the term he was elected to of deputy Momcilo Spasic, elected from the For European Serbia – Boris Tadic electoral list.

By the end of the day, the National Assembly had completed the joint discussion in principle on the first five items on the agenda.

On the second day of work, 3 March, the National Assembly conducted a joint discussion in principle and a unified discussion on the Bill on Pre-School Upbringing and Education, Bill on Pupil and Student Standard and Bill on the Confirmation of the Agreement between Serbia and Montenegro and the United States of America on the status of the International School of Belgrade.

The innovations introduced in the Bills were elaborated by the Minister of Education Zarko Obradovic.

By the end of the day the National Assembly had concluded the joint discussion in principle and the unified discussion on all three Bills.

On the third day of work, 4 March, the National Assembly conducted a joint discussion in principle and a unified discussion on items 8 and 31 on the agenda – the Bill on Wild Game and Hunting and the Bill on the Confirmation of the International Convention for the Protection New Varieties of Plants.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups, Aleksandra Jankovic, Cedomir Jovanovic and Radojko Obradovic requested information and/or explanations, under article 235 of the Rules of Procedure.

In the morning part of the sitting, based on the Republic Electoral Commission Report and the proposal of the Administrative Committee, the National Assembly noted the verification of the term of office of deputy Vladimir Ilic, elected from the For European Serbia – Boris Tadic electoral list.

By the end of the day the National Assembly had concluded the joint discussion in principle and the unified discussion on the Bill on Wild Game and Hunting and the Bill on the Confirmation of the International Convention for the Protection New Varieties of Plants.

On the fourth day of work, 5 March, the National Assembly conducted a joint discussion in principle and a unified discussion the Bill amending and modifying the Law on Scientific and Research Activities, Bill amending and modifying the Law on Innovative Activities, Bill on the Serbian Academy of Sciences and Arts (SANU), Bill on Geographical Indications, Bill on the Confirmation of the Patent Law Treaty and the Bill on the Confirmation of the Nice Agreement Concerning the International Classification of Goods and Services for the Purpose of the Registration of Marks of 15 June 1957, as revised in Stockholm on 14 July 1967 and Geneva on 13 May 1977 and as amended on 28 September 1979.

The Bills were outlined for the deputies by Deputy Prime Minister and Minister of Science and Technological Development Bozidar Djelic, representative of the submitters.

By the end of the day the National Assembly had concluded the joint discussion in principle and the unified discussion on items 9, 10, 11, 12, 16 and 17 on the agenda.

On the fifth day of work, 9 March, the National Assembly continued the session by a discussion in principle on the Amnesty Bill.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups, Nikola Krpic, Miroslav Markicevic, Radojko Obradovic and Boris Aleksic requested information and/or explanations, under article 235 of the Rules of Procedure.

On the behalf of the submitters, the Ministries of Justice and the Diaspora, the Amnesty Bill was elaborated by the Minister of Justice Snezana Malovic.

By the end of the day, the National Assembly had completed the discussion in principle on the Bill.


On the sixth day of work, 10 March, the National Assembly continued the session by a discussion in principle on the Bill amending and modifying the Law on State Land Survey and Cadastre of the Republic of Serbia, submitted by the Government under urgent procedure. The amendments and modifications to the Law were elaborated by the Minister of Environment and Spatial Planning Oliver Dulic.

In the course of the day, the National Assembly conducted and concluded the discussion in principle on the Bill amending and modifying the Law on State Land Survey and Cadastre of the Republic of Serbia.

The National Assembly went on to commence a discussion in principle on the Bill amending and modifying the Law on International Road Transport, which was explained by the Minister of Infrastructure Milutin Mrkonjic.

By the end of the day, the National Assembly had completed the discussion in principle on the Bill.


On the seventh day of the session, 11 March, the National Assembly conducted and concluded a joint unified discussion on items 18 through 28 on the agenda.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups, Miroslav Markicevic, Milos Aligrudic and Dragan Stevanovic requested information and explanations, under article 235 of the Rules of Procedure.

The Bills were outlined to the deputies by Ivica Dacic, representative of the submitters and First Deputy Prime Minister – Deputy Prime Minister and Minister of Interior.

In the afternoon, the National Assembly conducted and concluded a joint unified discussion on the Bill on the Confirmation of the Guarantee Contract (Refinancing short-term loan, construction of an underground gas storage facility and maintenance of gas transmission and distribution networks) between the Republic of Serbia and the European Bank for Reconstruction and Development and the Bill on the Confirmation of the Loan and Financing Agreement between KfW, Frankfurt an Main and the Republic of Serbia – Water supply and sewerage programme in medium-sized municipalities in Serbia I – Phase 2.

The Bills were outlined to the deputies by Verica Kalanovic, representative of the submitters, Minister for National Investment Plan.

On the eighth day of the session, 12 March, the National Assembly conducted a joint unified discussion on items 33, 35, 36, 37 and 38 on the agenda: the Candidate List for the Election of a member of the Council of the Republic Broadcasting Agency, submitted by authorised submitters, Proposal for the Election of Deputy Commissioner for Information of Public Importance and Personal Data Protection, submitted by the Commissioner for Information of Public Importance and Personal Data Protection, Request to relieve of duty a member of the Health Council of the Republic of Serbia, submitted by Prof. Dr Slobodan Jankovic, Proposal of the Decision determining the composition of the standing delegation of the National Assembly of the Republic of Serbia to the Francophone Parliamentary Assembly, submitted by the Speaker of the National Assembly of the Republic of Serbia and the Proposal of the Decision amending the Decision on the election of members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Socialist Party of Serbia (SPS) - United Serbia (US) Deputy Group.

At the beginning of the proceedings the Chair, National Assembly Speaker Slavica Djukic-Dejanovic, reminded the deputies that the Government had withdrawn the Proposal of the Decision on the Election of Chairman and members of the Republic Commission for the Protection of Rights in Public Procurement Procedures from procedure.

By the end of the day, the National Assembly had completed the joint unified discussion on these items on the agenda.

On the ninth day of the session, 16 March, the National Assembly completed a discussion on the particulars of the Customs Bill.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups, Dragan Todorovic, Miroslav Markicevic and Radojko Obradovic requested information and explanations, under article 235 of the Rules of Procedure.

In the afternoon part of the proceedings the National Assembly completed a discussion on the particulars of the Bill amending and modifying the Corporate Income Tax Law, Bill amending and modifying the Personal Income Tax Law, Bill on the indebtedness of the Republic of Serbia at Erste GCIB Finance I.B.V. Amsterdam, with Erste Bank a.d. Novi Sad as agent, Marfin Bank a.d. Belgrade and Vojvodjanska Banka a.d. Novi Sad, Bill granting guarantee by the Republic of Serbia in favour of Banca Intesa a.d. Belgrade under the debt of Public Enterprise Srbijagas Novi Sad and the Bill on Pre-School Upbringing and Education.

On the tenth day of the session, 17 March, the National Assembly debated the particulars of the Bill on Pupil and Student Standard.

In the morning part of the session the deputies conducted a discussion on the amendments submitted to the Bill.

In the afternoon part of the proceedings the National Assembly completed the discussion on the particulars of the Bill on Pupil and Student Standard and commenced a discussion on the amendments submitted to the Bill on Wild Game and Hunting

By the end of the day, the National Assembly had completed the discussion on the particulars of this Bill as well.


On the eleventh day of the session, 18 March, the National Assembly conducted a discussion on the particulars on the Bill amending and modifying the Law on Scientific and Research Activities.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups, Nikola Krpic, Aleksandra Jankovic, Vladimir Milentijevic, Dragan Todorovic and Nada Kolundzija requested information and explanations, under article 235 of the Rules of Procedure.

Based on the Republic Electoral Commission Report and Administrative Committee proposal, the National Assembly noted the verification of the term of office of deputy Lidija Dimitrijevic, elected from the Serbian Radical Party – Dr Vojislav Seselj electoral list.

In the morning, the National Assembly completed the discussion on the particulars on the Bill amending and modifying the Law on Scientific and Research Activities, and after it on the amendments to the Bill amending and modifying the Law on Innovative Activities.

A discussion on the particulars on the Bill on the Serbian Academy of Sciences and Arts was conducted in the afternoon.

By the end of the day, the National Assembly had completed the discussion on the amendments of this Bill as well.

The National Assembly commenced the twelfth day of the session, 19 March, with a discussion on the particulars on the Bill on Geographical Indications. In the morning part of the proceedings the deputies concluded the discussion on the particulars on both this and the Amnesty Bill.

By the end of the day the National Assembly had conducted and completed a discussion on the particulars on the Bill amending and modifying the Law on State Land Survey and Cadastre and the Bill amending and modifying the Law on International Road Transport.

Having completed the discussion on all the items on the agenda for the First Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2010 in principle and on the particulars, National Assembly Deputy Speaker Nikola Novakovic scheduled the Voting Day for Tuesday 23 March, starting at 12 p.m.

Voting Day

On Voting Day, 23 March, the National Assembly voted on the items on the agenda for the First Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2010.

By a majority of votes, the National Assembly adopted the following in their entirety: the Customs Bill, Bill amending and modifying the Corporate Income Tax Law, Bill amending and modifying the Personal Income Tax Law, Bill on the indebtedness of the Republic of Serbia at Erste GCIB Finance I.B.V. Amsterdam, with Erste Bank a.d. Novi Sad as agent, Marfin Bank a.d. Belgrade and Vojvodjanska Banka a.d. Novi Sad, Bill granting guarantee by the Republic of Serbia in favour of Banca Intesa a.d. By a majority of votes, the National Assembly elected Gordana Susa member of the Council of the Republic Broadcasting Agency.

The National Assembly elected Aleksandar Resanovic Deputy Commissioner for Information of Public Importance and Personal Data Protection, by a majority of votes.

The National Assembly went on to adopt the Decision to relieve of duty Prof. Dr Slobodan Jankovic, member of the Health Council of the Republic of Serbia.

The National Assembly also adopted the Proposal of the Decision determining the composition of the standing delegation of the National Assembly of the Republic of Serbia to the Francophone Parliamentary Assembly and Proposal of the Decision amending the Decision on the election of members of the Committees of the National Assembly of the Republic of Serbia.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the deputies complained of during the sitting and decided that the Rules of Procedure had not been violated in any of the cases.

Since the National Assembly had completed the discussion on all the items on the agenda and ruled on them, the Speaker of the National Assembly, Prof. Dr Slavica Djukic-Dejanovic, concluded the First Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2010.
